摘要
欺诈婚姻为一方当事人采用故意编造事实或故意掩饰重大情况的方式,从而使对方陷入错误的认识并作出结婚的意思表示而缔结的婚姻。其与无效婚姻、受胁迫婚姻相区别。在欺诈婚姻中,由于欺诈的具体类型不明确,婚姻效力及人身、财产关系不明确,对于弱者的救济途径不明确等问题,法律有必要对其进行具体规制。应将其纳入可撤销婚姻,受欺诈一方自知道欺诈事由起一年内可行使撤销权,被撤销的婚姻自始无效。
