网络庭审直播实证研究——以重庆市法院实践为样本

Empirical Research on Live Broadcast of Online Trial—Taking Chongqing Municipal Court Practice as a Sample

通过对重庆市部分法院实证调查发现,现阶段网络庭审直播工作虽然已经趋于常态化,但仍然存在一些问题,如不同地区的法院网络庭审直播发展不平衡,网络庭审直播案件类型比例不均衡,网络庭审直播形式化以及公众对于网络庭审直播关注度仍然不足。可以通过加强各地区法院基础建设,建立直播案件挑选规则,以及建立保障监管机制去除形式化和完善直播平台建设来实现网络庭审直播的完善,促进审判公开。

Through empirical investigations in some courts in Chongqing, it is found that although the live broadcast of online court hearings has become normalized at this stage, there are still some prob-lems. The formalization of online court hearing live broadcasts and the public’s attention to online court hearing live broadcasts are still insufficient. The improvement of online court hearings can be achieved by strengthening the infrastructure of various district courts, establishing live-streaming case selection rules, and establishing a safeguarding supervision mechanism to remove formaliza-tion and improve the construction of live-streaming platforms, and promote the publicity of trials.
