执委会是否应转为政府的问题探讨——基于长三角一体化示范区的建设

摘要 随着《长三角生态绿色一体化发展示范区总体方案》的发布,一体化示范区的体制,即“理事会 + 执委会 + 发展公司”的三层次管理架构随之公布,其后,基于体制阐述了一体化示范区的级别范围以及示范区内的执委会的性质界定。在对执委会应转为一级政府的现实分析中,为不使行政区划违背宪法及法律的相关规定,需要将示范区转为一级行政区域。然而,随着执委会的转变,会冲击现下的行政区划,难以实现两省一市合作共赢的最终目的,并且与原有区域内的其他行政机关的职责形成冲突。对于上述阻碍情形的造成,要想建设好长三角一体化示范区,必然不可支持由执委会到一级政府之间的转变,同时还应建立必要的派出机构来应对今后发展中可能会出现的问题,未雨绸缪。 With the release of the overall plan of the Yangtze River Delta Eco-green integration development demonstration zone, the system of the integrated demonstration area, in other words, the three-level of management structure which includes board of governors, executive committee and develop companies along with the overall plan. And then, based on the system, elaborating the level scope of integration demonstration area and the definition of the nature of the executive committee in the demonstration area. In the reality analysis of the executive committee should be transformed into a level of government in order not to make the administrative division violate the relevant provisions of the constitution and laws, it is necessary to transform the demonstration area into a level one administrative area. However, with the transformation of the executive committee, the current administrative divisions will be impacted, and it is difficult to achieve the ultimate goal of win-win cooperation between the two provinces and one city, at the same time, the duties of other administrative organs in the original region will be in conflict. The cause of the above hindrance situation tells us that if we want to build the Yangtze River Delta integration demonstration zone, the transition from the executive committee to a level of government must not be supported. At the same time, we should establish the necessary institutions to deal with difficult matters that crossing the administrative region in some demonstration areas. We should start from practice and try to take precautions before the matter happens.
