云南省国家公园法律制度研究

Research on the Legal System of National Parks in Yunnan Province

中共十九大提出“要建立以国家公园为主体的自然保护地体系”,云南是我国重要的生物多样性宝库和全球生物多样性热点地区之一,作为我国第一个国家公园试点省,云南省经过数十年的发展,已经取得了显著的成绩,但是由于国家层面尚没有相关法律法规的指导,云南省的国家公园法律制度存在着法制体系不健全、管理机构不明确、公众参与的程序和途径规定不足等问题。本文通过规范分析法,从云南省国家公园的发展状况入手,通过分析云南省国家公园的法律制度,并结合实践经验,进而提出了以下完善意见:云南省应该明确保护优先的原则,加快推进“一园一法”的立法,建立科学的管理体制,并且完善公众参与的途径与程序,从而推进云南省国家公园法律制度的建设进程。

The 19th Communist Party of China National Congress proposed “to establish a natural reserve sys-tem with national parks as the main body”. Yunnan Province is an important biodiversity treasure house in China and one of the global biodiversity hotspots. As the first National Park pilot province in China, Yunnan Province has made remarkable achievements after decades of development. However, due to the lack of guidance of relevant laws and regulations at the national level, the legal system of national parks in Yunnan Province has some problems, such as imperfect legal system, unclear management institutions, inadequate procedures and ways of public participation. Through normative analysis, starting from the development of Yunnan National Park, analyzing the legal system of Yunnan National Park, and combining with practical experience, this paper puts forward the following suggestions: Yunnan Province should make clear the principle of protection priority, accelerate the legislation of “One park One law”, establish a scientific management system, and im-prove the ways and procedures of public participation to promote the construction process of the legal system of Yunnan national park.
