环境侵权精神损害赔偿问题研究

Research on the Compensation for Spiritual Damage of Environmental Tort

在环境问题日益严重的今天,环境侵权作为一种特殊类型的侵权行为,由此引发的民事责任承担问题正在引起社会公众的广泛关注。环境侵权与一般的民事侵权有所区别,这种侵权所造成的损害既有人生命、健康和财产的损失,也有人精神利益的损害。生命、健康和财产损害按照现有的同质赔偿原则基本上可以得到相应的补偿,但是精神和环境权益的损害往往被排除在赔偿范围之外。本文从环境侵权精神损害赔偿的构成要件出发,分析了精神损害赔偿在环境侵权领域的适用原则,最后提出了环境侵权精神损害赔偿的实现路径,旨在探索出一种能够保护侵权行为人与受害人双方共同利益的法律制度,实现经济的良性发展和对生态环境的保护。

In today’s increasingly serious environmental problems, environmental tort as a special type of tort, resulting in the issue of civil liability is causing widespread concern of the public. The environmen-tal tort is different from the general civil tort. The damage caused by this kind of tort is not only the loss of human life, health and property, but also the damage of human spiritual interests. Life, health and property damage can be compensated according to the existing principle of homogene-ous compensation, but the damage of spiritual and environmental rights and interests is often ex-cluded from the scope of compensation. Starting from the constitutive requirements of spiritual damage compensation in environmental tort, this paper analyzes the applicable principles of spir-itual damage compensation in the field of environmental tort, and finally puts forward the realiza-tion path of spiritual damage compensation in environmental tort, aiming to explore a legal system that can protect the common interests of both the infringer and the victim, and realize the benign development of economy and the protection of ecological environment.
