我国善意取得制度之检视——以过错原则为视角

A Review of China’s Good Faith Acquisition System—Taking the Fault Principle as a Perspective

经济基础决定上层建筑,从所有权神圣不可侵犯到通过设立善意取得制度从而限制所有权,这些变化主要是因为我国从小农经济向资本主义经济所转所转变而形成的。本文想要解答的问题是:在目前我国的经济体制、中国特色社会主义市场经济制度下善意取得制度的嬗变。本人以过错责任原则为视角,仔细分析了善意取得制度之所以被大众所接受的原因并重点探究了善意取得制度的内在合理性。

The economic basis determines the upper buildings, from the sanctity of ownership to the re-striction of ownership through the establishment of a system of good faith acquisition, which is mainly due to the transformation of the small-scale peasant economy to the capitalist economy in China. The question that this paper wants to answer is: in the current economic system of our coun-try, socialist market economy system with Chinese characteristics under the change of good faith acquisition system. From the perspective of the principle of fault liability, I carefully analyze the reasons why the system of good faith acquisition is accepted by the public and focus on the inherent rationality of the system of good faith acquisition.
