农村宅基地使用权制度是我国一项特有的带有福利性的制度,在很长一段时期内其特有的社会保障功能为保障农村村民的生存居住以及促进乡村社会结构的稳固与经济健康发展发挥了巨大作用。但是在新型城镇化建设的形势下,相关法律法规及政策规定的宅基地使用权制度显然不能符合乡村振兴的要求。宅基地使用权制度应当如何改革才能符合乡村振兴的要求,改革的背后存在着怎样的立法意旨、价值取向与制度目标。要真正地了解、分析、解决问题,脱离其特定的历史背景是无法实现的。

The system of the right to use rural homesteads is a special welfare system in China. For a long period of time, its unique social security function has played a huge role in guaranteeing the survival and living of rural villagers and promoting the stability of rural social structure and healthy economic development. However, under the situation of new-type urbanization construction, the system of homestead use rights that stipulated by relevant laws, regulations and policies obviously cannot meet the requirements of rural revitalization. How should the system of homestead use right be reformed to meet the requirements of rural revitalization, and what legislative intention, value orientation and institutional goal are behind the reform? To truly understand, analyze and solve these problems, it is impossible to separate them from the specific historical background.
