近年来,刑事案件频发,其中不少被害人及其近亲属因穷尽一切正当途径而仍得不到赔偿以至陷入生活窘境,甚至有一些遭受不法侵害的被害人因得不到及时的赔偿而难以平复内心的不忿,进而产生“厌世”“埋怨社会不公”的情绪并做出常人难以预料的行为,甚至走上犯罪之路,从而由此案的被害人变为彼案的“加害方”,因此,相关国家机关应转变思路,加快推进被害人国家补偿的专门立法,以遏制此种情况的继续发生。
