论我国民事诉讼庭前会议制度的完善

On the Perfection of China’s Civil Litigation Pretrial Conference System

2012年《民事诉讼法》修订后首次出现了民事诉讼庭前会议制度的初样,2015年颁布的《民事诉讼司法解释》列入了庭前会议的字样,至此民事诉讼庭前会议制度得以正式确立。随着司法体制改革的不断推进,法院案件数量不断上升,案多人少的状况依旧持续。民事诉讼庭前会议制度作为民事审前程序的重要环节,是提高案件审判效率的重要手段。但该制度上在司法实践中尚存在一定的适用问题,文章欲从其制度概述、中外制度发展、问题探究以及完善对策论述民事诉讼庭前会议。

After the revision of the Civil Procedure Law in 2012, the first prototype of the civil litigation pretrial conference system appeared. The Judicial Interpretation of Civil Procedure promulgated in 2015 included the words of the pretrial conference, and thus the civil litigation pretrial conference system was formally established. With the continuous progress of the reform of the judicial system, the number of court cases has been rising, and the situation of more cases and fewer people still continues. As an important part of civil pretrial procedure, the system of civil pretrial conference is an important means to improve the efficiency of case trial. However, there are still some problems in the application of this system in judicial practice. The article intends to discuss the civil litigation pretrial conference from its system overview, the development of Chinese and foreign systems, problem exploration and improvement measures.
