离婚冷静期制度是一种设置在原有的离婚程序上的前置程序,有助于避免或者减少情绪冲动引发的轻率离婚。离婚冷静期条款中存在缺乏对离婚冷静期例外情形的规定、对夫妻权利义务关系规定不明确等问题。域外设置离婚冷静期的例外情形、区分离婚冷静期的非常规化情形值得我国借鉴。我国离婚冷静期条款中应增加离婚冷静期的例外规定、明确离婚冷静期内夫妻权利义务关系。
