摘要
劳动关系中劳动者的隐私权保护立足于对当前我国劳动者隐私权保护立法现状的研究,以《民法典》第一千零三十五条为背景,针对我国立法缺乏劳动者隐私权保护的明文规定、劳动者隐私权保护的指导原则、侵害劳动者隐私权的法律责任缺失等问题,分析得出民法与劳动法关于劳动者隐私权保护基本理念不契合、我国劳动者隐私权保护仍受隐私权可克减性观念影响、劳动者隐私权保护与促进市场经济发展需求难以平衡等原因,并提出确立劳动者隐私权保护的立法模式、构建劳动者隐私权保护的法律原则、明确侵犯劳动者隐私权的法律责任等立法建议,加以完善我国劳动者的隐私权保护。
The protection of the right to privacy of workers in labor relations is based on the study of the current legislative status of the protection of the right to privacy of workers in China, taking the 1035 of the Civil Code as the background, and aiming at the lack of explicit provisions for the protection of the right to privacy of workers in China’s legislation, the guiding principles for the protection of the right to privacy of workers, and the lack of legal liability for infringement of the right to privacy of workers. The analysis concludes that the basic concepts of the protection of the right to privacy of workers in the civil law and the labor law do not match, the protection of the right to privacy of workers in China is still affected by the concept of the derogation of the right to privacy, and the protection of the right to privacy of workers is difficult to balance with the need to promote the development of the market economy, and puts forward the establishment of a legislative model for the protection of the right to privacy of workers, the construction of legal principles for the protection of the right to privacy of workers. We should make clear the legal liability for violating the right to privacy of workers and other legislative suggestions to improve the protection of the right to privacy of workers in China.
