The Influence of Internet Public Opinion on Judicature—Jiang Ge Case and Yao Jiaxin Case from the Perspective of Comparative Law

随着互联网的快速发展,抖音、快手、B站等短视频平台被民众广泛应用,许多在过去我们无法注意到的案件极易进入大众的视野并且因为触动道德底线而引起民众激愤,民众往往在规则以外凭借朴素正义观追求所谓“正义”,这是一种社会监督但同时极易影响司法独立。本文将运用比较法,通过分析“药家鑫”以及“江歌”案,彻底厘清网络民意这只“无形”的手对司法的现实影响,以及如何建立正确机制引导民意,提出适合中国国情的司法未来发展策略,以期能够平衡社会利益与法律利益。

B station and other short video platforms are widely used by the public with the rapid development of the Internet. Many cases we cannot notice in the past are easy to enter the public’s vision and cause people’s indignation because they touch the bottom line of morality. People often pursue the so-called “justice” with the simple justice view outside the rules. This is a kind of social supervision, but it also can easily affect the independence of judiciary. This paper will use the comparative method, through the analysis of “Yao Jiaxin” and “Jiang Ge” cases, thoroughly clarify the practical impact of the “invisible” hand of online public opinion on justice, and how to establish a correct mechanism to guide public opinion, and put forward the future development strategy of justice suitable for China’s national conditions, in order to balance social and legal interests.
