The ancient Chinese concept of “cautious punishment” is an important component of traditional rule of law, and its development greatly influenced the judicial practice during the feudal period in China. To this day, the concept of “cautious punishment” is still reflected in contemporary Chinese justice, especially in the sentencing of special criminal subjects, among which the minor criminal subject is an important part of the special criminal subject. This article focuses on the research on the historical influence of the ancient Chinese thought of “prudent punishment” in the field of juvenile delinquency, introduces the origin of the thought of “prudent punishment” and its related institutional manifestations, and expounds the embodiment of the thought of “prudent punishment” in the field of modern juvenile delinquency and its practical significance in the field of contemporary prevention of juvenile delinquency.
