新时代乡村老人精神赡养法律困境和对策研究

A Study on the Legal Dilemma and Countermeasures of Spiritual Support for the Rural Elderly in the New Era

当前中国已经全面建成小康社会,如期实现第一个百年奋斗目标,人民物质生活水平得到了极大发展,共同富裕布局取得了长足进步,在这种背景下,作为中国人民年龄结构中最庞大群体的老年人在赡养方面提出了更高的要求,在物质层面赡养能够满足的基础上,老人开始追求精神层面的赡养,但是老人尤其是乡村老人的精神赡养却呈现出了显著的问题。本文通过剖析乡村老人精神赡养的法律困境,以及分析老龄化社会背景下老年人群体的需要和共同富裕目标下实现精神富裕的需要,最终提出在人民群众中提高精神赡养理念的熟识度、在法律层面完善精神赡养相关的法律条文、增加精神赡养的司法救济供给三条对策。

At present, China has built a well-off society in an all-round way and achieved the goal of the first century as scheduled, the people’s material living standards have been greatly developed, and the layout of common prosperity has made great progress. The elderly, as the largest group in the age structure of the Chinese people, have put forward higher requirements in terms of support. On the basis that material support can be satisfied, the elderly begin to pursue spiritual support. However, there are significant problems in the spiritual support of the elderly, especially in rural areas. By analyzing the legal dilemma of spiritual support for the elderly in rural areas, and analyzing the needs of the elderly under the background of aging society and the need to achieve spiritual prosperity under the goal of common prosperity, this paper finally puts forward three countermeasures: improving the familiarity of the concept of spiritual support among the people, perfecting the relevant legal provisions of spiritual support at the legal level, and increasing the supply of judicial relief for spiritual support.
