老龄化视域下我国智慧养老法制问题与路径探索

Exploration of Legal Issues and Paths for Smart Elderly Care in China from the Perspective of Aging

随着我国老龄化进程的速度加快,社会对养老服务行业的需求越来越高。近年来,智慧养老概念从智能家居、智能化老年系统发展而来,逐步深入到养老领域。智慧养老在给老年人带来便利化、智能化的服务、解决社会养老难题的同时,也面临着智能化体系下,老年人权利保护的立法不足、相关主体权利义务责任不明确、服务标准不明确、不统一等问题,本文试从立法、执法、司法三个方面探索其优化路径,以促进我国智慧养老的高质量发展。

With the rapid aging process in our country, the demand for old-age service industry is more and more high. In recent years, the concept of smart elderly care has been developed from smart home and intelligent elderly system, and has gradually penetrated into the field of elderly care. While bringing convenient and intelligent services to the elderly and solving social pension problems, smart pension also faces problems such as insufficient legislation on the protection of the rights of the elderly under the intelligent system, unclear rights and obligations of relevant subjects, unclear service standards and inconsistency. This paper tries to explore its optimization path from three aspects: legislation, law enforcement and justice, to promote the high quality development of wisdom endowment.
