论我国家族式腐败现状及其法律治理——以近三年中管干部家族式腐败情况为例

On the Current Situation of Familial Corruption and Its Legal Management—Taking the Family-Style Corruption of Administrative Cadres in the Past Three Years as an Example

家族式腐败是指国家公职人员及其家族成员滥用或者利用国家权力及其影响力,谋取私利的行为。本文首先以近三年我国中管干部家族式腐败情况为例,对我国家族式腐败现状进行了量化分析,并归纳总结了近三年我国中管干部家族式腐败的行为模式。其次对我国目前治理家族式腐败的法律规范进行了梳理和分析,指出了其中存在的不足。最后,根据我国目前治理家族式腐败的法律规范的不足,提出了相应的完善建议。家族式腐败相比于一般腐败社会危害性更大,本文主要研究我国治理家族式腐败的法律规范的不足及其完善,对我国更好地治理家族式腐败,打赢反腐败斗争具有重要意义。

Family corruption refers to the abuse or use of state power and influence by public officials and their family members to seek personal gains. This paper firstly takes the family-based corruption of cadres in our country as an example and makes a quantitative analysis of the current situation and summarizes the behavior pattern of the family-based corruption of cadres in our country in the last three years. Secondly, the author carded and analyzed the current laws and regulations of governing family corruption in our country, which points out its shortcomings. At last, according to the insufficiency of the legal rules governing familial corruption, some suggestions are put forward. Family corruption is more harmful to society than general corruption. This paper mainly studies the deficiency and perfection of the legal norms governing family corruption, which is of great significance for our country to better control family corruption and win the fight against corruption.
