人工智能生成物权利归属探究

摘要 近年来,随着互联网技术与深度学习技术的不断进步,使得人工智能技术逐渐向文学、艺术、教育等传统版权领域渗透,人工智能开始逐渐摆脱其工具性地位,由“辅助角色”转变为“创作角色”,甚至成为具备独立创作能力并能够产出创作成果的主体。当下人工智能产品的数量正不断增加,传统著作权法的保护模式慢慢表现出诸多局限性。目前我国著作权法中并未有明确的法律条款,对人工智能生成物给与相应的规范与保护,这势必会对人工智能及其相关行业带来不利影响。本篇论文采用阅读相关文献、分析现有案例以及关注域外立法等方法对人工智能生成物的权利归属问题进行探究并提出可行建议,现阶段我国法律应补充人工智能生成物权利主体的认定条件,并且还需完善人工智能生成物作品的认定标准。 In recent years, with the continuous progress of Internet technology and deep learning technology, artificial intelligence technology has gradually penetrated into traditional copyright fields such as literature, art, and education, and artificial intelligence has gradually shaken off its instrumental status, changing from an “auxiliary role” to a “creative role”, and even becoming a subject with independent creative capabilities and able to produce creative results. At present, the number of artificial intelligence products is increasing, and the protection model of traditional copyright law is slowly showing many limitations. At present, there are no clear legal provisions in China’s copyright law, which provide corresponding norms and protections for artificial intelligence products, which is bound to adversely affect artificial intelligence and its related industries. This paper puts forward feasible suggestions on the ownership of rights of artificial intelligence products by reading relevant literature, analyzing existing cases, and paying attention to extraterritorial legislation.
