我国农村地区社区矫正实务问题研究

Research on Community Correction Practice in Rural Areas in China

社区矫正是我国司法体制改革的一项重要举措,在降低刑事处罚成本、改造罪犯、维护社会稳定等方面发挥了积极作用。伴随着“恢复刑”理念的不断深入,社区矫正这一非监禁刑执行方式逐渐得到重视,2019年12月28日《社区矫正法》的颁布也意味着我国社区矫正工作上升到了新的阶段。然而,由于我国农村地区社区矫正工作尚处于起步阶段,实务中存在着诸多问题,如矫正环境不完善、矫正项目单一、矫正力量薄弱等。本文通过分析我国农村地区社区矫正实务中存在的问题,提出了完善矫正环境、丰富矫正项目、加强矫正力量建设等对策,以期为推进农村社区矫正工作提供参考。

Community correction is an important measure of the reform of the judicial system in China, which has played a positive role in reducing the cost of criminal punishment, reforming criminals and maintaining social stability. With the continuous deepening of the concept of “restoring punishment”, community correction, a non-execution method of imprisonment, has gradually been paid attention to. The promulgation of the Community Correction Law on December 28, 2019 also means that the community correction work in China has risen to a new stage. However, as the community correction work in rural areas of China is still in its infancy, there are many problems in practice, such as imperfect correction environment, single correction project and weak correction force. By analyzing the problems existing in the practice of community correction in rural areas of China, this paper puts forward the countermeasures such as improving the correction environment, enriching the correction projects and strengthening the construction of correction force, in order to provide reference for promoting the work of rural community correction.
