Protection Implications of Intangible Cultural Heritage in International Law

非物质文化遗产是人类智慧文明的结晶,其法律保护问题越来越受到国际社会的关注。本文主要讨论了非物质文化遗产的国际人权法保护、国际知识产权法保护、国际环境法保护以及部分跨国争议问题。最后在国际法视野下,从保护模式、保护机制、保护原则、保护主体维度探索完善现存的非物质文化遗产国际法律保护框架,最大限度保障其在维持和促进世界文化多样性方面的作用。

Intangible cultural heritage is the crystallization of human wisdom and civilization, and its legal protection has attracted more and more attention from the international community. This paper mainly discusses the protection of intangible cultural heritage by international human rights law, international intellectual property law, international environmental law and some transnational disputes. Finally, from the perspective of international law, it explores and improves the existing international legal protection framework of intangible cultural heritage from the dimensions of protection mode, protection mechanism, protection principle and protection subject, which might play a beneficial role in maintaining and promoting world cultural diversity to the maximum extent.
