摘要
智能办公化为用人单位招聘用工提供了便利,与此同时,劳动者个人信息处理不当的问题也始终贯穿劳动关系的全过程。通过对劳动者个人信息权保护司法案例的分析,可以看出劳动者个人信息权保护存在告知同意规则失灵、知情权及用工管理权界限不明、部分适用主体被排除等困境。面对数字化经济时代的到来,扩大适用主体范围、明确具体细化条款、规范企业个人信息的处理行为等措施具有重要意义。
Intelligent office provides convenience for employers to recruit workers. At the same time, the problem of improper handling of workers’ personal information runs through the whole process of labor relations. Through the analysis of judicial cases on the protection of workers’ personal information rights, we can see that there are some dilemmas, such as the failure of the notification and consent rule, the unclear boundary between the right to know and the right to manage employment, and the exclusion of some applicable subjects. In the face of the coming of the digital economy era, it is of great significance to expand the scope of application subjects, clarify specific terms, and standardize the handling behavior of personal information of enterprises.
