反垄断法在规制标准必要专利许可不公平高价行为发挥着重要作用,合同法与专利法也是不可或缺的。在标准必要专利许可中,专利权人请求的许可费明显超过FRAND原则,可以视为不公平高价,法院或者反垄断执法机构需要在多种计算方法中选择适当的方法确定专利许可费。若专利权人所要求的许可费高于FRAND许可费,需要承担反垄断法上的责任。

Anti monopoly law plays an important role in regulating the unfair and high priced behavior of standard essential patent licensing, and contract law and patent law are also indispensable. In standard essential patent licensing, the license fee requested by the patentee significantly exceeds the FRAND principle, which can be considered as an unfair high price. The court or antitrust enforcement agency needs to choose an appropriate method among various calculation methods to determine the patent license fee. If the patent holder requests a license fee higher than the FRAND license fee, they need to bear the responsibility under antitrust law.
