The Risks and Challenges of Smart Justice Construction and Its Response Ideas

21世纪是信息革命的时代,人工智能已然投入到智慧司法的建设中。发展智慧司法系统辅助司法工作者裁决案件,能够进一步提高司法效率,但在智慧司法的建设过程中仍然面临着诸多风险挑战。因此,文章将以我国智慧司法建设实践为切入点,梳理总结智慧司法建设的基本现状,在此基础上,深刻分析智慧司法建设所面临的风险挑战并提供应对思路。文章发现智慧司法建设面临的风险挑战主要包括:1) “算法黑箱”损害司法正义;2) 规则僵化分散司法裁判;3) 标准不一影响司法系统。以问题为导向,文章提出的相应对策有:1) 提升算法技术水平;2) 坚持人工智能在司法裁判中的辅助性工具定位;3) 加强信息共享,完善智慧司法制度设计,以期能为促进智慧司法的可持续发展提供一定参考。

The twenty-first century is the era of the information revolution, and artificial intelligence has been put into the construction of intelligent justice. The development of the intelligent judicial system to assist judicial workers to adjudicate cases can further improve the efficiency of justice, but there are still many risks and challenges in the process of the construction of intelligent justice. Therefore, the article will take the practice of China’s intelligent judicial construction as an entry point, combing and summarizing the basic status quo of the construction of intelligent justice, and on this basis, profoundly analyzing the risks and challenges faced by the construction of intelligent justice and providing ideas to cope with them. The article finds that the risks and challenges faced by the construction of intelligent justice mainly include: 1) “algorithmic black box” damaging judicial justice;2) rigid rules distracting judicial adjudication;and 3) inconsistent standards affecting the judicial system. Taking the problems as a guide, the article proposes corresponding countermeasures: 1) to improve the technical level of algorithms;2) to insist on the positioning of AI as an auxiliary tool in judicial adjudication;and 3) to strengthen the sharing of information and improve the design of the intelligent judicial system, with a view to providing certain references to promote the sustainable development of the intelligent judiciary.
