摘要
劳动者个人信息保护在信息化时代尤为重要。由于劳动关系从属性的特征,劳动者面对处于强势地位的用人单位,其个人信息常常受到侵犯而难以保障。我国虽然出台了关于保护个人信息的一般规则,但是却难以应用到劳动关系领域,因此本文探讨了劳动者个人信息保护存在的四个困境:未能将劳动者个人信息保护纳入到劳动法领域、用人单位知情权模糊、告知同意规则流于表面、劳动者举证困难。并为完善劳动者个人信息保护而提出了建议,将劳动者个人信息保护纳入劳动法领域,明确用人单位知情权界限,完善知情同意规则,平衡举证责任。
The protection of workers’ personal information is particularly important in the information age. Due to the subordinate characteristics of labor relations, the personal information of workers is often violated and difficult to protect when facing the employer in a strong position. Although China has issued general rules on the protection of personal information, but it is difficult to apply to the field of labor relations, so this paper discusses the four difficulties in the protection of personal information of workers: failure to incorporate the protection of personal information into the field of labor law, the employer’s right to know is vague, the rule of consent is superficial, and the worker’s difficulty in proving evidence. In order to improve the protection of workers’ personal information, the author puts forward suggestions, including the protection of workers’ personal information into the field of labor law, clarifying the boundaries of employers’ right to know, improving the rules of informed consent, and balancing the burden of proof.
