数据信托视域下个人信息保护方法探究

Exploring the Methods of Personal Information Protection under the Perspective of Data Trust

数字经济下,数据的使用是不可回避的过程,此过程需要数据的保护,但《个人信息保护法》中对于个人信息保护的方式还较为局限,个人敏感数据的保护在国内还面临重大挑战。而数据信托作为一种可行的个人信息保护路径,在英美国家已形成了其特有的数据信托模式。本文旨在分析其运作模式,总结其数据信托的经验,针对数据信托运行机制的建立提出建议,重点在于确定数据资产可被信托、明确使用者的权限、建立监管机制以及融合技术和法律,以促进我国数据信托制度的建立,佐证数据信托制度的建立对于我国个人信息的保护、社会公共信息的监管以及数字经济高质量发展具有实质性作用。

Under the digital economy, the use of data is an unavoidable process, and this process requires data protection, but the Personal Information Protection Law is still relatively limited in the way of personal information protection, and the protection of personal sensitive data is still facing major challenges in China. As a feasible path for personal information protection, data trust has formed a unique data trust model in the UK and the US. The purpose of this paper is to analyze its operation mode, summarize the experience of its data trust, and put forward suggestions for the establishment of data trust operation mechanism, focusing on determining that data assets can be trusted, clarifying the authority of the users, establishing a regulatory mechanism, and integrating the technology and the law, in order to promote the establishment of China’s data trust system, and to prove that the establishment of the data trust system has a substantial role to play in China’s personal information protection and regulation of the social and public information with high-quality development of digital economy.
