摘要
人工智能作为第四次工业革命的核心驱动力,变革了劳动方式,推动了劳动生产力的极大提高,释放了产业革命前所未有的巨大能量,创造了新的发展引擎,实现了社会生产力的整体跃升。同时,人工智能的发展让劳动者处于弱势地位,面临着前所未有的法治困境,《劳动法》亟需适应社会新变化并做出相应改变。同时国家应当从社会保障政策入手,逐步化解人工智能对劳动者权益带来的危机,最终全面构建人工智能时代的法治建设新格局,实现人与人工智能的良性发展。
Artificial intelligence, as the core driving force of the Fourth Industrial Revolution, has transformed the way of labor, greatly improved labor productivity, unleashed unprecedented energy in the industrial revolution, created new development engines, and achieved an overall leap in social productivity. At the same time, the development of artificial intelligence puts workers in a disadvantaged position and faces unprecedented legal challenges. The Labor Law urgently needs to adapt to new social changes and make corresponding changes. At the same time, the country should start with social security policies, gradually resolve the crisis that artificial intelligence brings to the rights and interests of workers, and ultimately comprehensively build a new pattern of rule of law construction in the era of artificial intelligence, achieving a healthy development between humans and artificial intelligence.
