Discussion on the Difficulties and Breakthrough Perspectives of Rural Land System Governance

本文希冀结合乡村振兴促进法及相关农业制度法规的相关规定与立法精神,建构适合乡村本土的多元主体“利益制衡”机制,研究提出存量留用、渐进发展、激发活力、保障稳健等措施,多方位稳控乡村土地制度治理困境突破,以此形成相适应的“利益制衡”机制助推乡村振兴,通过完善应用涉土地法律法规、加强乡村改革发展制度保障、突出农村土地规划引领等策略进一步深化乡村土地制度治理,核心解决农民在土地流转、土地权利人复杂的乡村发展趋势等方面存在的利益受损的困境和风险,厘清土地利用价值及其关系,制定促进提升农民利益为导向的合理规划措施,使乡村建设更好地与乡村振兴土地制度治理的近期趋势甚至长期目标相衔接。

This article aims to combine the relevant provisions and legislative spirit of the Rural Revitalization Promotion Law and relevant agricultural system regulations to construct a diversified “interest balance” mechanism suitable for local rural areas. Measures such as stock retention, gradual development, stimulating vitality, and ensuring stability are proposed to stabilize and break through the governance difficulties of rural land system in multiple aspects, in order to form a corresponding “interest balance” mechanism to promote rural revitalization, by improving the application of land related laws and regulations, strengthening the guarantee of rural reform and development system, highlighting the guidance of rural land planning, we will further deepen the governance of rural land system, core solutions to the difficulties and risks of interests damage for farmers in land transfer, complex rural development trends of land rights holders, and clarify the value and relationship of land use, develop reasonable planning measures guided by promoting the interests of farmers, so as to better align rural construction with the recent trends and even long-term goals of rural revitalization land system governance.
