摘要
随着现代信息技术的迅速发展,声音作为重要的传播媒介应用逐渐广泛,商品化程度不断加深,侵权现象愈发普遍。在影视艺术领域,台词声音作为普遍声音的特殊表现形式,同样面临着侵权风险。《民法典》准用肖像权的规定保护声音,但并未明确声音的法律属性。因此,界定声音的法律属性具有理论和现实意义。本文通过肖像权独立成权的过往经验证成声音权的法律属性,并以全国首例台词声音权纠纷案为抓手,从台词声音权主体、客体和对应性三要素出发,分析台词声音权的特性。在此基础上,从权利保护形态和方式角度提出法律保护建议,以促进台词声音权的规范化发展。
With the rapid development of modern information technology, the application of sound as an important medium of communication is gradually becoming more widespread, the degree of sound commercialization is deepening, and Violations of the right to sound are becoming more and more common. In the field of film and television art, the sound of lines, as a special form of expression of universal sound, also faces the same risk of being damaged. The Civil Code quasi-protects sound with the provisions of the portrait right, but does not clarify the legal attributes of sound. Therefore, it is of theoretical and practical significance to define the legal attributes of sound. This article proves the legal attribute of sound right through the past experience of an independent right of portrait rights, and takes the first dispute case of sound right of lines as a starting point to analyse the characteristics of the sound right of lines from the three elements of subject, object and correspondence of the sound right of lines. On this basis, it puts forward legal protection proposals from the perspective of the form and manner of protection of rights, in order to promote the normative development of the right to the sound of lines.
