劳动教育融入法学实践教学——知识融合、资源整合与知行结合的视角

摘要 劳动教育对于提升学生实践能力具有重要意义。在强调专业化教育的背景下,法学实践教学并未充分重视基础劳动教育。劳动教育有利于提升学生综合素质,为法学实践教学的高水平开展奠定基础。本文从知识融合、资源整合以及知行结合的视角,探究了法学实践教学如何有效纳入劳动教育,实现二者的良性互动,进一步提升法学学生的实践能力。从知识融合来看,学生应学习关于劳动教育的基本理念和知识,并在专业学习中整合专业知识和劳动知识,主要通过劳动法、知识产权法、合同法的学习加深对劳动及相应权利义务的理解。从资源整合来看,应着重实现高校、行业和相关部门的协同育人平台建设,建立相应的管理和评估机制,通过各类平台为学生劳动活动提供机会。就行知结合来看,应鼓励学生参与多样化的劳动活动,并将之纳入学生考评体系,为学生参与各类劳动实践提供有效激励。 Labor education is of great significance to improve students’ practical abilities. Under the back-ground of emphasizing professional education, law practice teaching does not pay enough attention to basic labor education. Labor education is conducive to improving students’ comprehensive quality and laying the foundation for the high-level development of legal practice teaching. From the perspective of knowledge integration, resource integration and the combination of practice and knowledge, this paper explores how to effectively integrate legal practice teaching into labor education, realize the benign interaction between the two, and further improve the practical ability of law students. From the perspective of knowledge integration, students should learn the basic concepts and knowledge of labor education, integrate professional knowledge and labor knowledge in professional learning, and deepen their understanding of labor and corresponding rights and obligations mainly through the study of labor law, intellectual property law and contract law. From the perspective of resource coordination, it is necessary to focus on the construction of collaborative education platforms for colleges and universities, industries and relevant departments, establish corresponding management and evaluation mechanisms, and provide opportunities for students’ labor activities through various platforms. In terms of the combination of practice and knowledge, students should be encouraged to participate in diversified labor activities and incorporated these activities into the student evaluation system to provide effective incentives for students to partici-pate in various labor practices.
