论香港立法会功能界别选举制度的合理性及发展前景

A Study on the Rationality and Prospect of Functional Constituency System of Hong Kong Legislative Council

对于香港立法会功能界别制度的存续问题,一直存在争论.从历史上看,该制度从港英政府时期至今已经运行了数十年,并随着社会发展不断变革或调整.功能界别制度对香港的经济繁荣和社会稳定起到了重要的作用,已成为香港政治制度的一个重要组成部分.本文从历史的角度切入,结合香港的社会现状,分析功能界别制度存续的合理性.无论是从法律、法理上看,还是从社会现状看,功能界别制度的存在都有必要.但该制度一直存在争议本身也说明了该制度还有一定的完善和发展空间.本文进一步分析功能界别制度的发展前景,希望该制度能更好地维护香港社会稳定,促进香港经济繁荣.

The detainment of functional constituency system is a controversial issue. This system has been running for more than thirty years,with several times of reform and improvement. There is no doubt that functional constituency system plays an important role on Hong Kong’s economic prosperity and social stability,and it has become an important part of Hong Kong’s political system. This paper aims at analysis the rationality of the detainment of functional constituency system. Firstly, it needs to study the history and social status of Hong Kong. Whether it is from the Legitimacy, Rationality or social status,the detainment of the functional constituency system is necessary.However, this system is still controversial which needs reform and improvement. The further analysis of development prospects of the functional constituency system would be presented in this paper, hope that the system can better safeguard social stability in Hong Kong, to promote Hong Kong’s economic prosperity.
