摘要
清代苗疆的款约、契约中常常出现宣扬“亲亲、尊尊”儒家伦理的表述,迄今黔东南苗族、侗族地区的新修楼房里还设有“天地君亲师”的神龛和神位.苗疆外结案件(包含秋审案件)之理讼是化苗成俗、沟通大小传统、型塑小传统的重要渠道,是苗人法律意识的鬼神化向儒家化逐渐转变的重要媒介,也是司法的儒家化的场域.
The principles of "qin-qin"(means close to oneself relatives)"zun-zun"(means prioritize the needs of the upper class) were frequently advocated in "kuan"(means social contacts in Miao areas) and Contracts of Miao areas in the Qing dynasty.Today the memorials to Heaven-Earth-Sovereign-Parent-Teacher are still fixed in the new houses of every home in the Qiandongnan Miao and Dong Autonomous Prefecture.The criminal cases occurred in Miao areas,and submitted to the Shing-pu,or Ministry of Justice,or Autumn Trials,for final adjudication,influenced the Miao people and formed moral customs,communicated with great tradition and shaped local tradition,converted the lagal consciousness of Miao people from deification of ghost to confucianization.
