论藏区赔命价与刑事法制的价值契合与制度对接

The revival of the Tibetan wergild in contemporary Tibetan areas has become one difficult problem in the practice of contemporary Tibetan areas,because the challenges and constraints it caused to the national criminal legal system. To solve this problem,we need to deeply understand the value of the Tibetan wergild as the traditional legal culture. Only by this,it can be well solved the conflict problem between the customary law and National Law about compensation for life. From the cultural perspective, we can find there are many-sided conjunction points between the Tibetan wergild and the criminal legal system. On this basis, we can research the system docking program between them,bring the Tibetan wergild into national criminal law. It can solve the contradiction and disputes between Tibetans, maintain social stability, and let the cultural value of the Tibetan wergild get the full play.
