Discussion on Constitutional Deliberation

Ⅰ.Constitutional Deliberation:Three Theoretical Levels The 'constitutional deliberation' is a concept-symbol,which has been widely described but not precisely defined.Through categorizing the present European and American academic resources,we can find that constitutional deliberation has theoretical presentation at three levels:The first level is constitutional deliberation in the weakest significance,which only emphasizes that the judges should introduce the mechanism and thinking for public debate and discourse into the course of constitutional interpretation (including constitutional review and constitutional ruling),but not stiffly back to the original intention of the framers.
