The combination of AI with the Internet, Big Data and cloud computing technology has greatly enhanced AI’s computing and data processing capabilities, it promotes the wide application of AI in various fields. As a kind of tool, its appearance makes the tool of crime upgrade, which also leads to the more complex pattern of some traditional crimes and the more harmful to the society. The first case of making AI plug-in crime in China was sentenced, and it is a traditional computer crime that changes the operation logic by combining with AI, which changes the behavior of traditional plug-in crime and the legal interests it infringes. Therefore, to make a new type of AI type of crime whether can be applied to make the same type of crime as the traditional type of crime, that is, “the provision of intrusion, illegal control of computer information system program and tools crime”, needs to be further discussed. To determine the nature of this new type of AI crime, we should judge its legal nature by studying its technical mechanism of operation, so as to sentence the most accurate crime.展开更多
