Analysis of Secondary Separation of China's Rural Land Rights from the Perspective of Analytical Jurisprudence

China's rural land rights are incomplete in structure of land rights and functions due to status restriction. Settling dispute and problem of status in rural land right and function structure is of great significance for determining and guaranteeing subjects of rural land rights. The point connecting and solving rural land circulation issue is demonstration and settlement of status. Separating the status right from rural land property right,namely the secondary separation of right,is to realize such purpose. Currently,China's rural land right is a bundle of rights,not the right described in property pedigree in strict sense. Using theory of rights of Hohfeld,this paper discussed and analyzed legal relationship of secondary separation of China's rural land rights,in the hope of realizing real return from practice to theory and to practice again.

Implications of Overseas Farmland Financial Development for Financial Service Innovation in China's Rural Areas

Currently,there are many problems requiring to be solved urgently in the rural economic development in China,including farmers' difficulties in getting loans,difficulties in agricultural financing of small and medium-sized enterprises,disconnection of funds chain and serious information asymmetry.The roots of these problems are inadequate financial support and single as well as backward service pattern.The development of rural economy and improvement of farmers' life depend in large measure upon rural financial service system.Rural financial business system in western developed countries mainly consists of policy finance,cooperative finance and commercial finance[1].Development of land finance provides powerful fund circulation for rural finance.Western countries have relatively advanced legal systems and policies for rural financial support with land mortgage and land guarantee as the main methods,which can be used as reference,such as construction of rural financial system,innovation of rural financial service as well as supervision and control of rural financial risks.Through introducing relevant features of foreign farmland finance,this article discusses service innovation in the reform of China's rural financial system.

Typical Experience and Legal Problems of Urban-rural Integration Development in Counties of Chongqing

With"people as the core",Chongqing vigorously explores the reform of integration of urban and rural elements in counties,gradually breaks down the institutional barriers that hinder the free flow and equal exchange of urban and rural elements,and promotes the balanced development of land,talent,medical care,pension,education and service towards"equalization"and"integration".Some typical experience practices and outstanding results have been formed.At the same time,restricted by system,capital,technology and other factors,there are still many"pain points"and"difficulties"in the integration of urban and rural development in counties of Chongqing.Based on the reform practice,some countermeasures and suggestions for the integrated development of urban and rural elements in counties of Chongqing were put forward.
