Justice is a crucial factor in effective linkages between social governance and the path to the rule of law, and the attainment of good social governance through justice is a basic marker of a rule of law society. Using the rational choice framework to examine representative individual cases, we can see that theories of participatory governance, self-governance and polycentric governance provide an approach to the interpretation of extreme social contradictions and the reduction of social conflicts, thus constituting a theoretical support and guiding direction for the reform of the judicial system. This will enable us to create a dispute resolution mechanism consistent with the concept of societal governance and judicial principles.展开更多

The question: will digitalization improving decisions in organizations be a relevant topic for all organizations7 Digitalization is currently the key driver for change in business and organizations. Affected is everything, from market structures to customer behaviour over supply chain and production itself. Internal processes have opportunities for a new design, and production and logistics are possible to redesign. This massive game changing opportunity has to be steered by management and hence management decisions are a must while this transition phase; furthermore, decisions will influence this transition but decisions itself are also affected. The paper is based on a theoretical research, analysing different decision models. In the first part of the paper, typical decision models will be discussed; a rational model with first ideas of the neoclassical economists (e.g. Adam Smith or Max Weber) and scientific approaches of Pascal and de Fermat or Bernoulli, mainly focused on agents which maximize their utility. Further developed by von Neumann and Morgenstern (2004), economic decisions seem to be a strong rational and mathematical process to find utility maximization. This rational model is illustrated on the one hand to explain the traditional way and has a view on the model of homo oeconomicus. On the other hand, a strong emotional influence on decision making is obvious, because human beeings do not follow strict rational rules. In the second part of the paper, digitalization as one part of globalization will be analysed. Digitalization will change completely the business environment and the setup of organizations. New market structures, customer behaviour, and processes will change the entire operations of businesses. Then, the main discussion of the paper, the impacts of digitalization on decision making will show the trend toward the well-known model of homo oeconomicus, which is a common model in economics; but known with a lot of limitations. Automatization of processes will affect the decision process in organizations. This new decision making processes will be mainly automated in the future, hence an algorithm logic is required and enables the model of homo oeconomicus a revival, driven by machines. As a conclusion based on the above mentioned result, automated decisions will improve the result of decisions, because human emotions will not affect the decision making process anymore.展开更多

Interpretation of a sample of influential lawsuits in the light of reason will reveal the core elements shaping the public's judgements on criminal cases, including both internal elements centering on trust, reputation and interaction and external elements centering on transaction costs. Our quantitative assessment of the role of trust, reputation and interaction in the public's views on criminal justice plus a comparison of the differences between their understanding and that of grassroots legal officials reflect the fact that underlying these rational choices is the clouding of judicial credibility due to contravention of the rules of justice. If we are to build judicial credibility, it is essential that we establish a sound relationship between the public and the criminal justice system, a relationship based on upholding the idea of rule of law and respecting the rules of justice.展开更多
In European politics,the issue of neo-liberalism is both dominant and contested.This political position has a foundation in an influential economic theory.This economic variant of a universal theory of human behaviour...In European politics,the issue of neo-liberalism is both dominant and contested.This political position has a foundation in an influential economic theory.This economic variant of a universal theory of human behaviour is known as‘economic imperialism’.It is very influential in the other social sciences as well.The‘rationalchoice-model’(RCM)is frequently employed to explain social phenomena.The RCM,formally speaking,is the approach of neoclassical economic theory.By scrutinising some presuppositions of economic imperialism,it becomes clear,however,that this approach cannot offer a universal theory of human behaviour.These considerations are not a criticism of economic rationality as such but of a specific interpretation of this rationality,namely that of economic imperialism.Although basic ideas of the RCM are criticised within the discourse of economics itself,such criticism has a primarily empirical nature.By contrast,this article develops a reflexive argument that concerns the framework of the RCM itself.RCM starts from assumptions that it does not justify,or is even unable to justify.Two of these assumptions are discussed in-depth:the givenness of preferences and the quantifiability of utility.It turns out that preferences of rational beings are not merely given but continuously evaluated.Moreover,preferences qua goals of action have a non-quantitative character:they are constituted by values.Values make up the foundation of(quantifiable)goods or preferences in the economic sense.展开更多
