This paper analyzes neighborhood conflicts arising from the condominium property regime,under which social housing promoted by Mexican government institutions and private developers is acquired.This regime has facilitated access to housing for the salaried population,but it is far from contributing to the attainment of the right to housing.The research takes as case studies housing complexes located in the city of Tijuana,Baja California,Mexico.The analysis included a mixed methodology.Firstly,similar case studies were analyzed;secondly,a review of the Condominium Property Regime Law was carried out in order to understand its implications.In view of the pandemic situation,a virtual survey was applied to the inhabitants of these areas,as well as interviews with presidents of neighborhood committees of these complexes.From the above,it was found that this form of ownership generates conflicts,reflected in the dissatisfaction of the inhabitants with their housing,disagreements and controversies in their organization and coexistence.The inhabitants have to collectively solve the problems they face,related to the maintenance and use of common areas,insecurity,and cleanliness,among others.In addition,there is a lack of support from local authorities.With this,it is concluded that although the inhabitants have a space that solves their housing problem,it does not manage to be a space that adequately guarantees their right to housing. 展开更多

In order to obtain a deeper understanding of the behavior of the structure under high wind load,this paper conducted an experimental study on a full-scale L-shaped single story light frame wood house under the uniform lateral load simulated using a gasbag.The investigation involved the performance of light frame wood structure after it experienced the repeated cyclic lateral wind load as well as the performance of the structure under the ultimate lateral load.Then,the study verified that light frame wood structure can resist repeated cyclic wind loads without observable degradation in stiffness during the anticipated serve life,and recommended shear wall percent drift restriction for lateral wind load design of wood structure in serviceability limit states is 1/400 drift,and in ultimate limit states is 1/80 drift.The conclusions of this paper can be benefit for the engineering practice of the light frame wood structures in high wind load regions. 展开更多

流动人口及其家庭在城镇安居是新型城镇化进程中流动人口市民化的重要内容,探索影响其定居城镇的决定因素具有十分重要的理论和现实意义。基于2017年中国流动人口动态监测调查数据,从住有所居的视角出发,探讨非正规的产权住房--小产权... 流动人口及其家庭在城镇安居是新型城镇化进程中流动人口市民化的重要内容,探索影响其定居城镇的决定因素具有十分重要的理论和现实意义。基于2017年中国流动人口动态监测调查数据,从住有所居的视角出发,探讨非正规的产权住房--小产权房对流动人口定居意愿的影响。研究发现:第一,小产权房通过其价格低廉化和在购买后形成的事实性占有提高了流动人口的定居意愿,但在现实中仍应高度警惕和重视小产权房对流动人口完整市民化和正规房地产市场健康运作带来的诸多负面挑战;第二,小产权房对流动人口定居意愿的“锁定”效应存在显著的群体异质性,在法律意识淡薄和对廉价住房需求高的“初中”“收入低”“老一代”流动人口群体中的影响作用更加明显,说明经济地位偏低和法律风险感知能力弱的流动人口在面对小产权房的低廉性时更容易作出“非理性”选择。这一结果预示着提供可负担的保障性住房和稳定城市住房价格,将附着在小产权房上的“廉价保障房”功能剥离开来,可能是解决小产权房问题行之有效的方式;同时,在治理和整顿存量小产权房时,要对蜗居其中的弱势流动人口群体予以充分的人文关怀,找寻保障弱势流动人口群体的住房权益与解决小产权房问题之间的平衡点和兼容性。 展开更多

A Perturbation Analysis of Low-Rank Matrix Recovery by Schatten p-Minimization

A number of previous papers have studied the problem of recovering low-rank matrices with noise, further combining the noisy and perturbed cases, we propose a nonconvex Schatten p-norm minimization method to deal with the recovery of fully perturbed low-rank matrices. By utilizing the p-null space property (p-NSP) and the p-restricted isometry property (p-RIP) of the matrix, sufficient conditions to ensure that the stable and accurate reconstruction for low-rank matrix in the case of full perturbation are derived, and two upper bound recovery error estimation ns are given. These estimations are characterized by two vital aspects, one involving the best r-approximation error and the other concerning the overall noise. Specifically, this paper obtains two new error upper bounds based on the fact that p-RIP and p-NSP are able to recover accurately and stably low-rank matrix, and to some extent improve the conditions corresponding to RIP. 展开更多

期房案外人执行异议之诉是指案外人针对期房执行异议被裁定驳回后所提起的诉讼。此诉讼的关键在于,案外人就正在执行中的期房是否享有可排除执行的权利。当前,关于期房案外人执行异议之诉的权利裁判规则,在立法层面仍显模糊,司法实践中... 期房案外人执行异议之诉是指案外人针对期房执行异议被裁定驳回后所提起的诉讼。此诉讼的关键在于,案外人就正在执行中的期房是否享有可排除执行的权利。当前,关于期房案外人执行异议之诉的权利裁判规则,在立法层面仍显模糊,司法实践中也面临众多问题。文章从91份最高人民法院的民事裁判文书入手,梳理审判实务中的裁判标准、审查路径以及裁判依据,全面审视司法裁判的现状,发现诸如期房权利类型不明确、物权期待权规则滥用、期房权利顺位规则不稳定等问题,皆为当事人纠纷之源。针对既有问题,提出完善策略,旨在为立法机关改善期房执行规则提供建议,为司法机关在期房权利裁判实践中提供参考,以期为期房权利主体提供更为坚实的法律保障。 展开更多

This paper considers approximately sparse signal and low-rank matrix’s recovery via truncated norm minimization minx∥xT∥q and minX∥XT∥Sq from noisy measurements.We first introduce truncated sparse approximation property,a more general robust null space property,and establish the stable recovery of signals and matrices under the truncated sparse approximation property.We also explore the relationship between the restricted isometry property and truncated sparse approximation property.And we also prove that if a measurement matrix A or linear map A satisfies truncated sparse approximation property of order k,then the first inequality in restricted isometry property of order k and of order 2k can hold for certain different constantsδk andδ2k,respectively.Last,we show that ifδs(k+|T^c|)<√(s-1)/s for some s≥4/3,then measurement matrix A and linear map A satisfy truncated sparse approximation property of order k.It should be pointed out that when Tc=Ф,our conclusion implies that sparse approximation property of order k is weaker than restricted isometry property of order sk. 展开更多

We propose a method for computing the maximum likelihood estimator (MLE) of parameters under the nonnegative restriction. A similar method is also proposed for the case that the parameters are restricted by a simple order: α1≥α2≥…≥αq and β1≥β2≥…≥βp. The strong consistency of the above two estimators is discussed. Furthermore, we consider the problem of testing homogeneity of parameters against the simple order restriction. A Simple Evaluation System for Microbial Property in Soil and Manure

Analyses of microbial properties in soil and manure had always included the problem that there was no available standard method to evaluate microbial property. The one of the major problems was the vast diversity and the enormous population of soil microorganisms [1], the other was an existence of numerically dominant unculturable microorganisms which comprise 99% of soil habitat [2]. We evaluated whether our newly developed method, by which taxonomies and their number of each bacterial groups were estimated, could be used as evaluation method of microbial properties of soils and manures. In the forest soil, β-Proteobacteria, which included Burkholderia sp., Ralstonia sp., and Alcaligenes sp., was numerically dominant bacteria (3.64 × 10<sup>6</sup> MPN g<sup>-1</sup> dry soil), followed by γ-Proteobacteria (1.32 × 10<sup>6</sup> MPN), δ-Proteobacteria (0.006 × 10<sup>6</sup> MPN), and the other gram negative bacteria (0.006 × 10<sup>6</sup> MPN). In the commercial manure, Actinobacteria, which included Streptoverticillium salmonis, Mycrococcus sp., Streptomyces bikiniensis, and Microbacterium ulmi, was numerically dominant bacterial group (30.8 × 10<sup>6</sup> MPN), followed by α-Proteobacteria (26.0 × 10<sup>6</sup> MPN), β-Proteobacteria (17.1 × 10<sup>6</sup> MPN), δ-Proteobacteria (11.2 × 10<sup>6</sup> MPN), the other Firmicutes (1.71 × 10<sup>6</sup> MPN), γ-Proteobacteria (0.5 × 10<sup>6</sup> MPN), and the other gram negative bacteria (0.05 × 10<sup>6</sup> MPN). In the upland field, the other Firmicutes, which included Paenibacillus sp., was numerically dominant bacteria (4.41 × 10<sup>6</sup> MPN), followed by Actinobacteria (2.14 × 10<sup>6</sup> MPN), Bacillus sp. (2.14 × 10<sup>6</sup> MPN), and γ-Proteobacteria (0.35 × 10<sup>6</sup> MPN). Although the precision of the affiliations became lower because of higher diversity of samples and the number of some Antinobacteria and Firmicutes might be underestimated by the used PCR condition, the method was found suitable as a candidate of a new evaluation system of soil and manure. 展开更多

2022年伊始,多地因开发商资金链断裂、楼盘项目停工,引发购房者集体断供,房屋预售模式负面效应凸显。预售模式的设计初衷是优先解决房企的融资问题,并未充分斟酌房企、银行与购房者的风险分担。期房交易中,由于标的物的非现实性和合同... 2022年伊始,多地因开发商资金链断裂、楼盘项目停工,引发购房者集体断供,房屋预售模式负面效应凸显。预售模式的设计初衷是优先解决房企的融资问题,并未充分斟酌房企、银行与购房者的风险分担。期房交易中,由于标的物的非现实性和合同履行的非即时性,房企利用其在交易信息、经济实力、商谈能力等方面的优势,逃避或转移部分预售风险,使得房屋预售模式异化为购房者单边风险负担。为此,应构建开发商、银行、购房者三方公平合理的风险共担机制。具体措施包括:探索预售资金的多元监管机制,完善预售资金的信息披露制度;完善物权期待权保护体系,优先保护善意购房者的利益;重塑购房者与银行之间的法律关系为Mortgage模式,若购房者因房屋未交付而选择断供,在法律上可不受后续还款义务的约束;增加银行与房企之间的担保约定,将购房者还贷意愿与房企的履约能力绑定;为限制房企将预售款获利挪用,应增加房企偿债能力约定、引入违约责任保险或违约惩罚赔偿。 展开更多

本文基于中国70个大中城市二手住宅销售价格的月度面板数据,采用多期DID方法,实证检验限购政策对地区房价增长率的影响及其作用渠道。研究结果表明:(1)住房限购并未扭转房价普遍上涨的局面,但是显著降低了房价上涨幅度,与未限购的城市相... 本文基于中国70个大中城市二手住宅销售价格的月度面板数据,采用多期DID方法,实证检验限购政策对地区房价增长率的影响及其作用渠道。研究结果表明:(1)住房限购并未扭转房价普遍上涨的局面,但是显著降低了房价上涨幅度,与未限购的城市相比,住房限购城市房价增长率下降0.9%,并且政策对房价的调控效果具有持续性;(2)同一经济区内城市间限购政策出台具有空间关联性,区域内限购城市比例越高,本地限购的概率越大;(3)住房限购通过降低住房市场关注度和价格预期抑制房价增长;(4)一二线城市、房价水平高、市场关注度高的城市以及华北、长三角、东南沿海和中部经济区的城市住房价格增长更易受到限购政策的影响。相关结论为政府因城施策、调整改进购买引导政策、稳定市场预期、建立区域住房市场联动机制提供依据。 展开更多

随着中国能源资源开采逐步向深部转移,采用浅部参数研究深部问题、采用静态参数研究动态问题会造成工程设计时的科学依据不足。由于黏土的初始应力状态对其动力学性质有显著影响,本文采用长时、分级、高压固结方式模拟黏土的原始应力赋... 随着中国能源资源开采逐步向深部转移,采用浅部参数研究深部问题、采用静态参数研究动态问题会造成工程设计时的科学依据不足。由于黏土的初始应力状态对其动力学性质有显著影响,本文采用长时、分级、高压固结方式模拟黏土的原始应力赋存环境;采用分离式霍普金森杆(SHPB)试验装置对侧限条件下的高压固结黏土进行峰值应变率范围为200~800 s^(–1)的冲击压缩试验,分析了黏土应力记忆效应、应变率效应和动态压缩过程。结果表明:黏土的应力历史影响了其动态压缩过程,试样依次经历压实段、线弹性加载段、线性卸载段;在动载下,黏土压实段与线弹性加载段应力拐点的均值为3.8 MPa,与先期固结应力4.2 MPa具有相关性,且压实段应变均值约为试样破坏应变的33%。采用200和300 mm的短子弹进行冲击加载时,黏土试样未发生稳定的塑性变形;分析应力–应变率曲线发现,黏土的压实过程吸收了一部分动载能量,使其无法持续进行动态压缩行为,但进入动态压缩阶段后黏土受子弹长度影响较小;黏土试样动态加卸载段模量随应变率同步增加,但加卸载模量的比值稳定在0.45左右,表明更高的冲击速度没有造成试样进一步损伤,这与冲击后的宏观破坏现象及塑性变形分析相互印证。针对软弱、松散颗粒体材料,高压固结方式为研究其动力学性质提供了一种思路。 展开更多

“房住不炒”的要求已成为中国房地产市场发展的顶层设计和长期指针,引导房地产市场良性循环发展,有助于防范系统性金融风险,更是经济高质量发展的必然要求。通过建立多部门动态随机一般均衡(DSGE)模型,分析比较房产税、宏观审慎政策对... “房住不炒”的要求已成为中国房地产市场发展的顶层设计和长期指针,引导房地产市场良性循环发展,有助于防范系统性金融风险,更是经济高质量发展的必然要求。通过建立多部门动态随机一般均衡(DSGE)模型,分析比较房产税、宏观审慎政策对房地产市场调控的优劣性。研究表明,面向家庭和企业的房产税均能抑制房价上涨,宽松信贷环境下征收房产税易加剧经济波动,而紧缩信贷环境叠加房产税则会导致经济“过冷”发展。提高房产税率后,房产将在不同家庭之间产生“再分配效应”,有助于改善居民收入差距。房产税政策具有显著的结构化优势,在实现社会福利改进的同时引起产出和通货膨胀的波动较小,而宏观审慎政策在防范系统性风险方面占优,同等程度冲击下,房价下降程度更高。房产税政策更符合房地产市场长效发展的内在要求,应加快构建现代房产税征收制度,探索试点范围和方式。在实践中应综合考量经济情形实施有差别、有浮动的房产税率,信贷紧约束的情形下应审慎使用房产税,当房地产市场过热时应同时叠加使用房产税和宏观审慎政策,发挥房产税的价格调控和收入分配作用。 展开更多
