Thoughts on Promoting the Investment and Financing Development of Enterprises'Intellectual Property Rights from the Perspective of Intellectual Property Strategy

With the in-depth implementation of China's intellectual property strategy,the situation of intellectual property protection in China has been further improved,the enthusiasm of the public for entrepreneurship and innovation has been further stimulated,people's awareness of intellectual property rights has been further enhanced,and the value of intellectual property rights has been further recognized by people.As a new economic form,"intellectual property economy"plays an increasingly important role in our socialist market economy.At the same time,China's intellectual property still faces some prominent problems,especially in the field of intellectual property investment and financing,such as difficult valuation,management and liquidation.From the perspective of the implementation of intellectual property strategy and starting from the investment and financing of intellectual property rights of small and medium-sized enterprises,this paper introduces the basic concepts of intellectual property investment and financing,the development status and existing problems of intellectual property investment and financing of small and medium-sized enterprises,and puts forward some suggestions for improving the investment and financing policy of intellectual property rights.

Study on Agricultural Intellectual Property Protection and High-Quality Development of Traditional Chinese Medicine of Ginseng

Agricultural intellectual property has the functions of carrying forward agricultural cultural heritage,encouraging agricultural scientific and technological innovation,cultivating the brand of agricultural products and so on. The protection and application of agricultural intellectual property rights can enhance the vitality,innovation and competitiveness of agricultural economy,and promote the strategy of high-quality agricultural development and rural revitalization. Ginseng is a traditional medicinal variety with superior characteristics in Northeast China,and it is one of the most famous " three treasures" in Northeast China. This paper introduces ginseng( Panax ginseng C. A. Mey.) and its medicinal value,analyzes the traditional knowledge,biological genetic resources,new plant varieties,patents,geographical indications,trademarks and other agricultural intellectual property resources of ginseng,studies the traditional Chinese medicine GAP certification and certification of " Three Agricultural Products" and the construction of the dominant area of agricultural product( Fusong ginseng) with Chinese characteristics,and explores the rural revitalization strategy and traditional Chinese medicine development strategy,ginseng agricultural intellectual property protection and high quality development strategy.

Protection of Intellectual Property and Authenticity of Chinese Herbal Medicine Chrysanthemum morifolium

This paper first introduced Chrysanthemum morifolium Ramat. and its medicinal value. Then, it studied agricultural intellectual property resources such as geographical indications, trademarks, patents, new plant varieties, biological genetic resources, and traditional knowledge related to C. morifolium . Finally, it summarized poverty-stricken areas ecologically suitable for planting C. morifolium , analyzed the GAP certification of C. morifolium , pollution-free agricultural product certification, green food certification, and organic food certification, and discussed the strategies for C. morifolium intellectual property protection and authenticity protection in the context of TCM development strategy and rural revitalization strategy.

Inheritance,Innovation and Development of Wuling Mountain Area in Hubei Province Based on Intellectual Property Rights

Using the methods of field survey and literature collection,this paper firstly introduces the intellectual property resources of the Wuling Mountain Area in Hubei Province from folk literature and arts,traditional knowledge,biological genetic resources,new plant varieties,patents,geographical indications,and trademarks.Then,it analyzes the main problems in the protection and inheritance,innovation and development of intellectual property rights(IPRs).In addition,it discusses the strategy of inheritance,innovation and high-quality development of this ethnic area in the context of the strategy of strengthening the country with intellectual property rights and the strategy of rural revitalization.Finally,it comes up with recommendations including carrying forward and inheriting folk literature and art,protecting traditional knowledge of traditional craftsmanship,inheriting and innovating to develop traditional Chinese medicine and ethnic medicine,improving the protection and use of geographical indications,and strengthening the IPR protection.

A Study on Intellectual Property Right Protection of Geographical Indications and Regional Public Brand Building in Xinjiang

This paper studies the geographical indication resources of Xinjiang and their distribution in administrative regions,national grain production functional zones,protected zones for production of major agricultural products,advantageous areas of Chinese characteristic agricultural products,and national advantageous characteristic industrial clusters.It analyzes the main problems existing in the protection of intellectual property rights of geographical indications.Besides,it discusses the strategies for the protection of intellectual property rights of geographical indications in the autonomous region and the building of regional public brands in the contest of the strategy of strengthening the country with intellectual property and rural revitalization strategy.Finally,it comes up with recommendations,including collecting and sorting out the human factors and natural factors of geographical indications of famous,excellent and special products,strengthening the protection of geographical indications of Xinjiang cotton and its products,enhancing the protection of geographical indications of grain and oil crops and sugar beet,implementing the protection of geographical indications for products with special needs for ethnic minorities,building national geographical indication product protection demonstration areas,formulating national and international standards for geographical indication products,and take full advantage of the EU-China Agreement on Cooperation on and Protection of Geographical Indications to actively participate in the EU protection of geographical indications.

Intellectual Property Protection and High-quality Development of Cotton Industry in Xinjiang

This paper firstly introduces the general situation of cotton planting areas in China and cotton industry in Xinjiang,and the current situation of intellectual property protection of Xinjiang's cotton industry.Then,it analyzes the main problems in its intellectual property protection and high-quality development.On this basis,it comes up with the recommendations for high-quality development of cotton industry in Xinjiang under the strategy of strengthening the country with intellectual property.The recommendations include improving the level of creation of creative intellectual property rights,building an intellectual property rule system in the entire cotton industry chain in Xinjiang,building protected zones for production of major high quality agricultural product cotton,establishing a demonstration zone to undertake the transfer of the domestic cotton textile and garment industry,undertaking education on the sense of community for the Chinese nation in response to the Xinjiang cotton incident,and developing the"Belt and Road"blue market for Xinjiang cotton and its products.

Strengthening Protection Of Proprietary Intellectual Property Rights and Implementation of Technology Standard Strategies

This article focuses on the current situation in technical research and development （R＆D） and proprietary intellectual property rights （IPRs） in China. Cotton Breeding in Xinjiang and Its Intellectual Property Protection

In 2021,Xinjiang's cotton output was 5.129 million t,accounting for 89.50%of China's total.The autonomous region produces high-quality long-staple cotton,natural colored cotton,fine-staple cotton(upland cotton),organic cotton,etc.The southern Xinjiang cotton area is one of the three major long-staple cotton(island cotton)producing regions in the world.This paper introduced the history of cotton planting and breeding in Xinjiang from the aspects of cultural relics records,history of entering Xinjiang,historical achievements of breeding and breeding leaders.We studied the intellectual property protection of cotton breeding in the autonomous region from the aspects of biological genetic resources,invention patents,utility model patents and new plant varieties,analyzed the six main problems existing in cotton breeding and its intellectual property protection,and discussed the tactics for cotton breeding and its intellectual property protection in Xinjiang under the strategy of strengthening the country with intellectual property.Eight suggestions in response to the Xinjiang cotton incident were also put forward,including establishing a Xinjiang national cotton germplasm nursery,protecting biological genetic resources,and strengthening the protection of creative intellectual property rights in the field of breeding to escort technological innovation in the cotton seed industry.

高校国家知识产权信息服务中心建设研究:路径及策略

数字技术锁定:侵蚀效应与解锁策略研究——基于逆向锁定视角

数字技术研发应用推动创新内涵嬗变。探讨数字技术创新潜藏逆向锁定风险,基于技术路径依赖理论,结合2011—2021年中国上市公司数字技术专利申请数据,采用非径向超效率SBM方法测度我国数字技术锁定,检验数字技术锁定对数字经济发展的侵蚀效应。研究发现:(1)数字技术锁定对数字经济发展存在显著侵蚀效应,且该影响遵循“显著侵蚀—侵蚀效果收敛—侵蚀效果强化”这一非线性轨迹;(2)受技术空间扩散影响,数字技术锁定对数字经济发展具有“邻地侵蚀”效应;(3)与内部技术引进相比,外部技术引进能显著打破数字技术逆向锁定演进轨道,处于弱制度创新环境的地区通过技术模仿遏制数字技术锁定的边际收益更高;(4)技术消化吸收对数字技术锁定的遏制效果在区域间存在非对称性特征,知识产权保护能为知识吸收和数字技术成果转化提供坚实的制度保障。研究结论可为数字经济时代下化解数字逆向锁定风险、突破“数字锁定枷锁”提供策略指引。

我国知识产权公共服务标准化试点城市网点建设现状与策略研究——以广州市为例

[目的/意义]知识产权公共服务网点是知识产权公共服务体系中的关键环节,也是赋能科技创新全链条、打通公共服务“最后一公里”的基础力量,对完善知识产权公共服务体系、赋能培育新质生产力、助力经济社会高质量发展具有重要作用。[方法/过程]采用网络调研、问卷调查和实地访谈等方法,梳理我国知识产权公共服务的发展脉络和建设概况,以及全国首批知识产权公共服务标准化试点城市建设情况,并以广州市为例调查其服务网点现状。[结果/结论]研究发现,目前广州网点建设主要存在经费来源不稳定、人才队伍不健全、标准化程度不高、网点机构协同性不强、服务宣传推广力度不足、区域发展差距较大等短板,并针对性提出强化公共服务政策保障和经费支持、强化区域性公共服务体系、强化公共服务多元化供给、强化公共服务人才引育留用全链条、强化服务机构分类分级差异化发展、强化公共服务支撑科技与产业作用、强化公共服务宣传引导和案例推广等方面的对策建议。

知识产权战略与企业数字化转型--基于渐进双重差分模型的实证分析

知识产权示范城市作为国家知识产权战略实施的先行示范区发挥着重要作用,知识产权战略对企业数字化转型也有积极意义。基于2008—2021年沪深A股上市公司数据,使用渐进双重差分模型(DID)验证知识产权战略是否对企业数字化转型产生影响。结果表明,知识产权战略能够显著赋能企业数字化转型,通过平行趋势和动态效应检验、安慰剂检验和倾向得分匹配等多种稳健性检验后,结论依然成立;从作用机制来看,知识产权战略通过专利补贴促进效应和技术创新激励效应显著赋能企业数字化转型。

为深入理解知识产权战略本质,提升知识产权战略有效性,需要从源头探讨知识产权战略内涵,开展必要的战略评价,基于多种理论视角探讨提升路径和优化问题。知识产权战略内涵的多向度、多侧面性反映出知识产权战略的复杂性和艺术性特征。知识产权战略比较重要的四个向度分别为财产、价值、竞争、形式与结构向度等。根据对知识产权战略内涵的认知,提出了战略评价与战略匹配、战略成熟度、PDCA循环、动态演化与调控、政策引导与综合治理等多个路径。相关路径体现了战略知识产权管理(SIPM)程度、战略专业性、契合性、体系性、演化性和可调控等方面特点,有其合理性。

国家知识产权战略对高技术产业创新效率的影响——基于时间断点回归设计

在我国从知识产权大国向知识产权强国迈进的关键时期,探究实行国家知识产权战略对高技术产业创新效率的影响,既是推动高技术产业升级的有效手段,也是改革完善知识产权保护与管理制度的内在需求。基于2000—2019年中国28个省市地区高技术产业创新数据,运用时间断点回归方法检验中国实施国家知识产权战略对高技术产业创新效率的影响。研究表明:国家知识产权战略的实施在整体上显著促进高技术产业创新效率提升。区域异质性分析发现,战略实施显著提升了东、西部地区高技术产业的创新效率,但对中部地区创新效率的提升作用不显著。研究结论为优化知识产权政策设计、提高高技术产业的创新能力提供了经验证据。未来应进一步健全知识产权制度体系,并结合区域差异因地制宜制定知识产权政策。

基于“认知—技术—法治”框架的交通知识产权“走出去”研究

知识产权治理已成为交通现代化治理和交通国际合作的重要内容,交通知识产权“走出去”能促进交通运输行业自立自强、实现交通运输技术创新、扩大交通运输对外开放、促进交通企业可持续发展、推动构建人类命运共同体。本文基于“认知—技术—法治”框架分析交通知识产权“走出去”的现状及面临的主要问题,借鉴美欧日在国际交通知识产权竞争中的经验,探究推动交通知识产权“走出去”的路径与对策。提出中国应该积极参与全球交通知识产权治理,主动参与国际规则制定,缩小与相关国家或地区在知识产权制度、保护、运用、管理、服务等方面的差距,消除或减少我国交通企业“走出去”的知识产权障碍,为交通领域知识产权全球治理贡献中国智慧与方案。
