Human Rights and Development:China's Contributions Based on a Larger Concept of Human Rights

The Western liberal view of global governance can no longer effectively address the challenges facing the world today or respond to the demands of developing countries in the fields of human rights and development.Meanwhile,the United Nations human rights and development agenda also has its limitations.Against such a backdrop,China's path of human rights development has avoided the trap of human rights confrontation and the clash of civilizations.It has set an example of complementarity and positive interaction between human rights and development by unifying collective human rights with individual human rights and integrating the universality and particularity of human rights.Xi Jinping,general secretary of the Communist Party of China(CPC)Central Committee,delivered a speech at the 37th group study session of the Political Bureau of the CPC Central Committee on China's Path of Human Rights Development.This elevated China's human rights development to a new historical height.Practice has proved that China's concept and path of human rights in the new era have not only effectively promoted the development of its human rights cause,but also contributed Chinese wisdom to the global cause of human rights and development with a larger concept of human rights.Under the framework of the concept of building a community with a shared future for mankind,the Belt and Road Initiative,and the Global Development Initiative,China has contributed to enhancing the discourse power of developing countries in human rights and building a fairer,more just,more reasonable and more inclusive system for global human rights governance.

Research on the Constitutional,Historical and Practical Logic of the Chinese Path of Human Rights Development——From the Perspective of the Inclusion of Human Rights Clause in the Constitution

The inclusion of the human rights clause in the Chi-nese Constitution is a concern and expression of the spirit of the Con-stitution,which has laid the institutional regulations of the fundamen-tal law for the development of human rights in China,provided the principles and value norms of the highest level of effectiveness for the legal protection of human rights,and built a profound constitutional basis for the formation and improvement of the Chinese path of human rights development.The human rights clause is not only a summariza-tion and affirmation of the historical practice of Chinese human rights development under the leadership of the Communist Party of China,but also a new starting point for the development of human rights in China under the leadership of the Communist Party of China.It marks that the development of human rights in China has entered a new era.The Party and the state have finally embarked on a path of human rights development with Chinese characteristics by formulating and implementing the Human Rights Action Plan of China,eliminating ab-solute poverty through the national poverty alleviation campaign,and promoting human rights protection through the rule of law.

Viewing Chinese modernization and Its Requirements for Human Rights Protection from the Perspective of Human Development

Modernization,as a specific stage in the historical development of human society,possesses a multi-layered composite structure,with each layer playing both a promoting and inhibiting role in human development and dignity simultaneously.Chinese modernization is a strategic choice made based on lessons learned from various experiences of modernization processes in other countries,reflecting judgments on the benefits and choices on the values of human development and dignity in modernization.It values the promotion of the free and well-rounded development of all individuals as its standard,demanding the full realization of the positive effects of modernization on human development and the overcoming of its negative effects.Human rights,aiming to promote the free and well-rounded development of every person as the ultimate value goal,are not only an intrinsic structural element of the modernization stage but also a social normative tool that restrains the direction of modernization development,aligning closely with the values pursued by Chinese modernization.Chinese modernization poses dual requirements for human rights protection:on the one hand,it demands the affirmation and promotion of the positive effects of modernization on human development and dignity through human rights standards,and on the other hand,it requires the prevention and mitigation of the negative effects of modernization on human development and dignity through human rights standards.There exists a certain tension between these two dimensions,necessitating an appropriate balance and thereby presenting corresponding requirements for China’s approach to human rights protection.

Pioneering a New Realm of Human Rights Civilization in the Chinese Path to Modernization——An Overview of the Symposium on“The Chinese Path to Modernization and the Promotion of Free and Comprehensive Human Development”

On October 14,2023,a symposium themed“The Chinese Path to Modernization and the Promotion of Free and Comprehensive Human Development”was held in Changchun,Jilin Province,China.More than fifty experts,scholars,and researchers from national institutions and universities engaged in discussions and exchanges on human rights on the Chinese path to modernization,including the path,practice,knowledge systems,and civilization forms of human rights.This symposium played a significant role in advancing the construction of the disciplinary system,academic system,and discourse system of human rights in China.

To cultivate new professional farmers is a key way for rural labor development, resolving existing problems such as how to farming. It is notable that government and market take advantages in training of new professional farmers. Therefore, it is necessary to guarantee government and market playing the roles. The research explored market-oriented farmer training model and the characteristics and investigated training routes for new professional farmers.

Digital Development Rights in Developing Countries:Where the Governance Rules for Cross-Border Data Flows

The digital development rights in developing countries are based on establishing a new international economic order and ensuring equal participation in the digital globalization process to achieve people's well-rounded development in the digital society.The relationship between cross-border data flows and the realization of digital development rights in developing countries is quite complex.Currently,developing countries seek to safeguard their existing digital interests through unilateral regulation to protect data sovereignty and multilateral regulation for cross-border data cooperation.However,developing countries still have to face internal conflicts between national digital development rights and individual and corporate digital development rights during the process of realizing digital development rights.They also encounter external contradictions such as developed countries interfering with developing countries'data sovereignty,developed countries squeezing the policy space of developing countries through dominant rules,and developing countries having conflicts between domestic and international rules.This article argues that balancing openness and security on digital trade platforms is the optimal solution for developing countries to realize their digital development rights.The establishment of WTO digital trade rules should inherently reflect the fundamental demands of developing countries in cross-border data flows.At the same time,given China's dual role as a digital powerhouse and a developing country,it should actively promote the realization of digital development rights in developing countries.

Current Situation of Farmers' Specialized Cooperatives in Hainan Province and Development Strategies

This paper introduces the distribution, membership structure and industrial structure of farmers' specialized cooperatives in Hainan Province, and points out some problems in farmers' specialized cooperatives in Hainan Province, such as small scale, low ability to resist risks, lack of standardization in operation, and generally low quality of cooperative members. Finally the following development strategies are put forth: promoting the large scale and standardized development of farmers' specialized cooperatives; enhancing institutionalized education and training for members; encouraging university graduates to work in the cooperatives; providing conventional credit support to cooperatives; increasing fiscal efficiency to support cooperatives.

Cultivating New-type Farmers Based on the Theory of Human Resources Development

Under the direction of theory of human resources development,this thesis analyzes the impact of rural human resources development oncultivating new-type farmers.Firstly,it increases the input of rural basic education;secondly,it reinforces the vocational education and technologytraining;thirdly,it promotes the rural medical and public health services;fourthly,it quickens the rural labor transfer.The status quo of China's ruralhuman resources has been analyzed as follows:in terms of the quantity of rural human resources,the status quo is large and quick-developed baseof rural human resources,high labor participatory rate,and constitution of low age;in terms of the quality of rural human resources,the status quois the ubiquitous low quality of rural human resources,low technological level of rural human resources,and overall low physical quality of farmers;in terms of the structure of rural human resources,the status quo is the irrational industrial structure distribution and imbalanced regional structuredistribution.The thesis also discusses the edification of theory of human resources development in cultivating new-type farmers.First,in terms ofthe control over quantity of rural human resources,it is to keep the stability of family planning policy,and expedite the transfer of rural surplus la-bor;second,in terms of promoting the quality of rural human resources,it is to bolster the development of reserve rural labor force resources,toconstruct the adult educational training system with Chinese characteristics,and to build rural primary health care system;third,in terms of adjus-ting the structure of rural human resources,it is to perfect rural human resources market,and adjust rural economical structure and talents struc-ture.

Effect of Agricultural Comprehensive Development on Increasing Income of Farmers in Jiangsu Hilly and Mountainous Areas

To adapt to rural and agricultural economic development,Jiangsu Province adjusted main task of comprehensive development of hilly and mountainous areas to supporting and promoting agricultural structural adjustment of hilly and mountainous areas and promoting increase of agricultural benefits and farmers' income. Through typical survey,this paper made an objective evaluation of effect of agricultural comprehensive development of hilly and mountainous areas in Jiangsu Province from increasing farmers' income. Results indicated that agricultural comprehensive development investment projects in Jiangsu hilly and mountainous areas are closely coupled with local agricultural production structure; financial funds promote social capital input to construction of economic forest,fruit and grass planting,and livestock raising. Through demonstration and guidance of farmers,it promoted adjustment of agricultural production structure and increased farmers' income. Finally,it came up with pertinent policy recommendations.

Development and Economic Effect of Farmers' Specialized Cooperatives

The paper introduces the present development of farmers' specialized cooperatives in China, points out that although the cooperatives in China develop rapidly, they are generally small and their advantages cannot be given into full play, and then analyzes the development achievements of the cooperatives, for example, they have realized scale benefits, their management system tends to more mature, the economic value of their brands is improved and they have created great economic benefits. The paper also points out the stable development path for the cooperatives, that is, the cooperatives should cooperate with local villages, and take a path of combined village and cooperative development so that the cooperative members can get a stable income; the cooperatives can also cooperate with local leading enterprises, which can help the cooperatives to manage, sell and form their products brands, thus the cooperatives can get loans easily to solve the capital bottleneck of cooperative development and improve the members' incomes.

Management Models and Development Strategies of the Farmers’ Professional Cooperatives in the Western Poor Counties and Regions of China: A Case Study of Long’an County,Guangxi

In the new era,an important task is how farmers’professional cooperatives to better adapt to new development environment and effectively solve the problems that"who will cultivate land"and"who does agriculture depend on"in the future.In this paper,model and development direction of farmers’professional cooperatives in Long’an County of Guangxi are analyzed and studied based on realistic development background of Guangxi.

Review and Prospect of Development Capability of New Generation Farmers

In the context of dual economic structure,there occurs shift of numerous rural surplus labors in China. As a special group lingering about in the edges of urban and rural areas,the new generation farmers become a hot spot of research. How to help them smoothly become successors of China's agricultural modernization construction is a focus of academic circles. Based on literature review,this paper analyzed connotation of development capability of new generation farmers from agricultural modernization,thinking ability construction,system and policy,and new farmers. Finally,it came up with prospect for development of new generation farmers.

The Disputes over "Normal Development" and "Natural Growth" of Farmers' Cooperatives——On the Basis of Empirical Analysis on Farmers' Cooperatives in Deyang City

Combining the disputes on the "normal development" and "natural growth" existing in farmers' cooperatives and according to the actual investigation statistics, the management model selection and regulation (including model selection, policy encouragement, operation scale and scale selection ) of farmers'cooperatives in Deyang City, share structure and governance structure( including the establishment way and share structure, reserve sharing and dividend distribution, organization structure and policy-making mechanism), capital raising situation and financial support of farmers' cooperatives in Deyang City are analyzed empirically. It is pointed out the farmers' cooperatives should take the road "normal development".

Cultivation Model of New Farmers under the Urban Rural Development: A Case Study of Guangdong Province

Different from traditional farmers, new farmers refer to the high-quality farmers who are educated and skilled, and have the capability of operating. Cultivation of new farmers is a key factor of developing rural human resources, and also the lasting power for the new countryside construction. Guangdong Province has witnessed rapid urbanization and industrialization, and local farmers have been faced with the competition with foreign quality talents and the pressure of survival. Against the background of new countryside construction, this paper studied the supply-demand situation and problems of traditional farmers in Guangdong Province, explored education and cultivation model of new farmers and innovation mechanism, which is signifi cant for improving the innovation level of Guangdong, and promoting the urban-rural coordinated development.

Farmers＇ Perception of Soil Erosion Control Measures： Implications for Sustainable Development in Agriculture and Environment in South East, Nigeria

The study investigated farmers＇ perception of soil erosion control measures and highlighted implications for sustainable development in agriculture and environment in southeast, Nigeria. Purposive, multistage and random sampling techniques were employed in selecting a sample size of two hundred and forty （240） respondents. Structured interview schedule was used for data collection, while percentages, mean ratings and factor analysis techniques were employed for analysis. The findings show that majority （64.6%） of farmers were within the ages of 40-59, while majority （67.9%） had either FSLC or WASCE/SSCE/GCE/OL qualifications. The farmers reported that the major soil erosion control measures used were strip cropping （M = 4.8） and making of ridges against slopes （M = 4.7）. The study reported that poor group affinity, inadequate institutional support and inadequate technical knowhow were constraints to soil erosion control in southeast, Nigeria. The study highlighted implications for sustainable development in agriculture and environment on organizational overhaul in extension, participatory extension policy on farmers groups and institutional re-orientation and synergy between Universities, Agricultural Development Programme （ADP）, Ministry of Agriculture （MOA） and Local Government Councils. In conclusion, success in soil erosion control and sustainable development in agriculture and environment in southeast, Nigeria depends on the extent issues raised and implications highlighted can be addressed. The study recommends improved funding support to extension, participatory extension training and contacts with farmers＇ groups and groups＇ resources management.

Present Situation and Development Mode of Chinese Farmers' Cooperative Organizations

In developed countries,the typical modes of farmers' cooperative organizations are " German mode", " Japan and South Korea mode" and " American mode". The development of farmers' cooperative organizations in China is the product of need and being needed,with low level of specialization,systematism and industrialization. However,Chinese farmers' cooperative organizations have the advantages of diversification,full supporting and great opportunities of Internet economy and e-commerce environment. Based on that,this paper puts forward the " Chinese mode" for the development of farmers' cooperative organizations in China in the future,that is,the main body of innovation and entrepreneurship will unite,and the other entities of production and industry will follow them.

Current Development Situations and Countermeasures for Tobacco Farmers' Specialized Cooperatives in Hunan Province

This paper firstly introduces development history of China's farmers' specialized cooperatives and connotation and mechanism of tobacco farmers' specialized cooperatives. Then, it analyzes current development situations of tobacco farmers' specialized cooperatives in Hunan Province. On the basis of analysis, it puts forward development countermeasures, including realizing circulation of tobacco land, strengthening propaganda of laws on tobacco farmers' specialized cooperatives, increasing operation effect of tobacco farmers' specialized cooperatives, enhancing guidance and supervision of tobacco farmers' specialized cooperatives, as well as improving specialized service level.

Construction of China Osmanthus City and Intellectual Property Right Protection in Xianning City in the Context of Three New Developments

Xianning City of Hubei Province is one of the five major traditional osmanthus producing areas in the world and the hometown of osmanthus in China. Xianning is constructing China Osmanthus City in the whole city. This paper first introduces the main characteristics of the osmanthus industry in Xianning City, and analyzes the characteristics of traditional knowledge, biological genetic resources, new plant varieties, patents, geographical indications, and trademarks. Then, it studies the intellectual property resources of the osmanthus industry, and analyzes the main problems existing in the construction of China Osmanthus City and intellectual property right protection. Finally, it comes up with constructive recommendations including applying for China and Globally Important Agricultural Heritage Systems, developing colored-leaf osmanthus varieties, creating a regional public brand of osmanthus specialty products, and building a new development pattern of osmanthus industry.

The Right to Carbon Emission: A New Right to Development

For the past few years, the international community has regarded the right to carbon emission as a new right to development. The legal basis of this mainly includes “the United Nations Framework Convention on Climate Change”, “the Kyoto Protocol” as well as the sustainable development principle, the principle of common but differentiated responsibilities and the principle of fairness and justice, etc. The distribution of the right to carbon emission of the post-Kyoto age should consider the need of development, population, historical responsibility, the principle of fairness and justice and other factors. As a dominant country of greenhouse gas emission, on the premise of sticking to “the principle of common but differentiated responsibilities”, China should achieve the transformation from the “difference principle” to “common responsibilities” progressively. Meanwhile, in strengthening coordination with developing countries, China should appropriately support the requests of the Alliance of Small Island States and the least developed countries and attach importance to the issue of the right to development in the distribution of the right to carbon emission.

Inheritance,Innovation and Development of Wuling Mountain Area in Hubei Province Based on Intellectual Property Rights

Using the methods of field survey and literature collection,this paper firstly introduces the intellectual property resources of the Wuling Mountain Area in Hubei Province from folk literature and arts,traditional knowledge,biological genetic resources,new plant varieties,patents,geographical indications,and trademarks.Then,it analyzes the main problems in the protection and inheritance,innovation and development of intellectual property rights(IPRs).In addition,it discusses the strategy of inheritance,innovation and high-quality development of this ethnic area in the context of the strategy of strengthening the country with intellectual property rights and the strategy of rural revitalization.Finally,it comes up with recommendations including carrying forward and inheriting folk literature and art,protecting traditional knowledge of traditional craftsmanship,inheriting and innovating to develop traditional Chinese medicine and ethnic medicine,improving the protection and use of geographical indications,and strengthening the IPR protection.
