Analysis of Hidden Danger in Farmer's Rights and Interests during Farmland Transfer——An Evaluation of Rights Safeguarding Effect of Farmland Transfer Contract

Taking Shuangliu County,Chengdu City,China as an example,evaluation index system for the rights protection effects of farmland transfer is established contract from three aspects of basic information,transfer agreement and legal safeguards in the contracts.According to the investigation data,weight of evaluation index is determined by both entropy weight and Analytic Hierarchy Process.Comprehensive index method is used to evaluate the rights protection effects of farmland transfer contract in the flat dam,high hill and low hill in Shuangliu County,Chengdu,China.Result shows that the transfer agreement of farmland and the basic information of contract greatly affect the rights protection effects of farmland transfer contract.There are differences in the five indices of the information of the signature of contract,pricing for payment,time limit for farmland transfer,transfer mode of farmland,and use range of farmland transfer.During the farmland transfer in reality,there are three hidden dangers in farmer's land rights and interests,which are the ill-formed transfer behavior,the relatively low income of farmers from farmland transfer,and the quality decline of farmland and difficult full reclamation in transfer period.Based on the evaluation result and investigation data,countermeasures are put forward to improve the rights protection effects of farmland transfer contract.

This paper analyses the status quo of migrant workers' lack of cultural rights and interests as follows:the holistic cultural life of migrant workers is scant and monotonous;the cultural facilities provided by the majority of enterprises are critically short;the cultural life of migrant workers has the characteristic of closeness to some extent;the holistic cultural consuming capacity of migrant workers is very low,and they are not satisfied with their own cultural life.This paper puts forward the measures that the government should adopt to make up for the lack of migrant workers' cultural rights and interests as follows:first,it should eliminate discrimination in terms of system,and incorporate migrant workers' cultural rights and interests into the building scope of urban public culture;second,it should establish a variety of free public culture facilities,to adapt to the needs of migrant workers;third,it should formulate various kinds of laws and regulations,to effectively safeguard migrant workers' cultural rights and interests.

劳动权益保障、政府信任与高龄农民工的城市融合

基于调研数据,本文考察了劳动权益保障对高龄农民工城市融合的影响机制。实证结果显示,工资拖欠、工伤纠纷、劳动合同纠纷等劳动权益受损事件均会显著影响高龄农民工城市融合程度。对劳动权益纠纷解决过程的进一步考察发现:第一,劳动权益受损事件发生后,当高龄农民工对维权过程解决较为满意时,其城市融合程度显著高于没有发生过劳动权益纠纷者;第二,政府部门主导解决劳动权益纠纷对高龄农民工城市融合具有一定的“放大效应”。当高龄农民工对维权解决过程满意时,解决过程中的政府干预会显著提高其城市融合程度;当其对维权解决过程不满意时,解决过程中的政府干预反而使其城市融合程度下降的幅度更大。因此,本文认为应健全源头预防,杜绝劳动权益纠纷事件发生;建立农民工劳动权益保护协调机制;强化政府责任意识,属地监管、多部门协同,发挥政府在高龄农民工劳动权益保障工作中的积极作用。

新媒介使用与农民工权益表达——一个有调节的中介效应模型

通过对北京、上海、广州、湖南等省市农民工的调查研究,探索新媒介使用、权益认知、权益损害程度及维权效能感等因素和农民工权益表达之间的影响关系。研究发现:新媒介使用虽能直接影响权益表达,但效果有限,权益认知和权益损害程度等因素在新媒介使用影响权益表达过程中起到中介作用。新媒介使用通过权益认知和权益损害程度影响权益表达的中介过程受到维权效能感的调节作用:较高的维权效能感在权益认知和权益损害程度中介路径上起正调节作用;较低的维权效能感只在权益损害程度中介路径上起正调节作用;维权效能感在新媒介使用直接影响权益表达路径上调节作用不明显。

徐玲治疗风湿寒性关节痛用药规律分析

目的:通过数据挖掘方法,总结、提炼名医徐玲治疗风湿寒性关节痛的用药规律。方法:通过用数据挖掘方法分析徐玲治疗风湿寒性关节痛处方,探索名医徐玲治疗风湿寒性关节痛的用药规律及相关学术经验。结果:最终结果统计出名医徐玲一定时间段所涉及到的证型以风湿痹阻证、脾肾亏虚证、风寒阻络证为多,涉及中药有95味,其中频次超过20次的中药为桂枝、白芍、黄芪、甘草、当归、独活、防风等;四气五味统计出温性药物居多;药味统计以辛、甘味最多;药物归脾、肝两经居多;药物功效以补虚类药物使用频次最多,其次为祛风湿药、解表药等;通过关联规则可以看出强连接数的药对有16对;运用聚类分析结果可以得出治疗风湿寒性关节痛的核心处方3个。结论:徐玲治疗风湿寒性关节痛用药分析后得出,以补脾益肾,柔肝止痛,祛邪除痹为治疗原则,体现“祛邪守中”的治疗理念。

大学生食品消费维权的困境与解决对策

近年来,食品安全问题时有发生,大学生是一个特殊的群体,大学生食品安全维权状况备受关注。本文以广东外语外贸大学南国商学院的大学生为调查对象,概述了大学生在食品消费维权中存在的问题,分析了产生问题的原因,并提出相应的解决对策。

非物质文化遗产数字化成果财产权的建构

非遗数字化成果关涉公共利益,其是否有必要采取私法保护的路径、是否能够作为财产权的客体,亟待澄清。为纾此困,通过“Encoding/Decoding”理论窥探非遗数字化成果受财产权保护的理据,从而明确非遗数字化成果作为财产权客体的法律地位。值此,既与非遗的生产性保护内在契合,又形成了对利益相关者的激励效用。依据非遗数字化成果生成与传播过程中所承载的不同私益品性,可将非遗数字化成果财产权界分为创作者的财产权与传播者的财产权,二者虽然在具体客体上有所差别,但权利内容均以控制权、利用权和处分权为核心。同时应当看到,拘囿于非遗的数字化系以非遗的保护传承为旨归,且其亦是对非遗利用方式的延展,非遗数字化成果财产权主体的权利须受到非遗权利人的制约,并应当以非遗的保护传承作为权利保护的边界,藉此消解非遗数字化成果的确权保护与非遗保护传承的表面张力。

黄河流域水权交易法律保障机制研究

水资源配置是黄河流域水资源管理的核心,水权交易制度是促进黄河流域水资源高效配置的一项重要制度。黄河流域开展水权交易是适应黄河流域生态保护和高质量发展的战略需要,有利于解决黄河流域水资源短缺及供需矛盾、提升黄河流域水资源利用效率。但是,目前黄河流域水权交易存在初始水权配置缺乏动态调整、用水权确权不彻底、水权市场定价机制不完善、水权交易利益相关者利益补偿机制缺位等问题。因此,为落实黄河流域生态保护和高质量发展战略,建立黄河流域各省(区)初始水权分配动态配置机制、深入推进用水权精准确权、优化水权交易市场定价机制、建立水权交易利益补偿机制和完善水权交易市场培育机制等显得非常关键。

试析数字化时代下数字人权的困境和出路

在当前的数字化社会中,数字人权面临着理论和现实的种种困境。理论上,数字人权深陷理论偏狭,学界对其地位的认可并不统一。实践中,数字资源分配不均,导致数据利用主体之间地位不平等,数字霸权和网络暴力现象屡见不鲜。为了满足现实社会对于数字人权承认和保护的新需求,可以完善数字人权的法律规范体系,加强对数据掌控者的监督。同时,政府发挥监管和救济作用,防止出现数字霸权事件,执法和司法机关加强对网络环境的审查和执法力度,数字弱势群体也加强自身数字素养的提高,培养数字意识。各方综合发力,才能真正解决数字人权面临之困境,数字生产力也能得到进一步提升。

公法权利视角下的档案利用权研究

《档案法》在总则中明确规定了档案利用权,为档案利用打开了新的视野。在档案利用法律关系中,档案馆的性质影响到档案利用权的性质确定。在我国现行法律的规定中,档案馆可以认定为公法人,具有行政法上公物的法律性质;档案利用者可以分为公共组织的单位和作为私主体的单位与个人,前者的档案利用权属于作为公务利用,而后者的档案利用权具有主观公权利属性。当档案利用主体认为其利用权受到侵犯时,可以通过投诉、复议和诉讼的方式寻求救济。
