The right to education is an important part of basic human rights. To transform from a designed vision to a reality in practice, teachers’ right to discipline, as a component of the right to education, needs tangible...The right to education is an important part of basic human rights. To transform from a designed vision to a reality in practice, teachers’ right to discipline, as a component of the right to education, needs tangible support from the criminal law. The criminal law cannot be absent from promoting the rule of law in education. However, in practice, teachers’ disciplinary behaviors are often ex-cessively criminalized, leading to problems such as over-expanding punishment and harming the innocent and even the malaise that en-danger substantive justice such as the tarnishing of teachers’ disci-plinary right and the imbalance of teachers’ disciplinary behaviors. Such overcriminalization has its social causes and normative crux, which is the ambiguity of regulations of teachers’ disciplinary right in terms of the pre-existing law and the unclear positioning of the jus-tification of teachers’ disciplinary behaviors in terms of the criminal law. Therefore, it is necessary to carry out a dual clarification of the chaotic parts of the two laws and determine the corresponding guiding principles, and test them one by one through the hierarchical theory of crime to make the path of exculpation clear. At the level of constituent elements, the exculpation is achieved through the normative judgment of the constituent elements;At the level of illegality, the exculpation is achieved by virtue of substantive considerations of reasons such as le-gal acts, legitimate defense, and victims’ commitments;At the level of accountability, the exculpation is achieved through the value screening of the culpability paradigm. We should reverse the trend of overcrim-inalization of teachers’ disciplinary behaviors by clearing the way of exculpation.展开更多

These nonverbal behavior exert a subtle influence on the students, thus affect the classroom teaching. The English teachers' classroom nonverbal behavior in a higher vocational college in Gansu province was investigated through questionnaires. The results indicate that the teachers' behaviors affect the different aspects of students and then influence the effectiveness of teaching on English classroom teaching in higher vocational college.展开更多

Purpose: Given the unique characteristics of physical education(PE) teaching in K-12education,PE teachers' information behaviors deserve special attention.This article reports a survey study of PE teachers' in...Purpose: Given the unique characteristics of physical education(PE) teaching in K-12education,PE teachers' information behaviors deserve special attention.This article reports a survey study of PE teachers' information behaviors,covering information literacy skills and behaviors of information seeking and information use.Design/methodology/approach:A questionnaire survey was conducted of K-12 PE teachers in the Tianjin municipal region of China,with a response rate of 61.9%.Findings:PE teachers lack skills with information retrieval systems in general.The Internet continues to be their primary information source,and they rely more on personal collection and colleagues than the school library for teaching materials.They rarely develop a searching strategy,employ querying tactics,or use advanced search functions,and they tend to be content with finding a few relevant articles.Research limitations:The survey is limited to the Tianjin municipal region in scope.Though attempting to reach 210 participants from 40 schools,it yielded only 130 valid responses.A larger survey covering more regions and with greater responses may be useful.Practical implications:Insights from this study inform the educational and on-job training of K-12 PE teachers to improve their information literacy skills.Originality/value:Little research exists on PE teachers' behaviors of information seeking.This study bridges the gap and enriches our understanding of K-12 teachers' information behaviors.展开更多

Partici...The purpose of this study was to examine the professional disposition scores of Physical Education teacher candidates over time. In ad-dition, differences between teacher and student ratings were investigated. Participants were 65 students who completed three methods courses (A, B, and C) across a two-year period. Both the teacher and the students completed a profes-sional dispositions instrument in each of the three classes. Results indicated a decrease in disposition self ratings and teacher ratings over time. A 2 (Rater) x 3 (Time) ANOVA revealed that the student and teacher ratings were different for classes A and B but not for class C. The findings are encouraging in light of the strong alignment between teacher and student ratings in the upper-level class. The dispositions in-strument appears to be a valid and reliable method to assess the professional behaviors of teacher candidates.展开更多

It is affected by many factors. In vast rural areas in China, practically speaking, behaviorist approach fits in with the writer’s own experience. Some weaknesses of this approach are also discussed.
