On the Value Reconstruction and System Innovation of the Labor Contract Law

Since its very release in March 2006, the opinion-soliciting draft of the Labor Contract Law has sparked considerable controversy. Indeed, the whole process of its consideration, promulgation, implementation and amendment has been accompanied by complex questioning and a diversity of views. This has to some extent reduced appreciation of the value of the Labor Contract Law itself. In the economy and society, rational legal construction can minimize the damage done by the failure of private negotiations. The Labor Contract Law is dedicated to changing the action space of workers and enterprises in order to promote efficiency in production and equity in distribution. With the aim of constructing and developing harmonious and stable labor relations, the law seeks to encourage workers and enterprises to forge communities of shared interests, shared undertakings, a common destiny and a joint mission; it is here that the true value of the law lies. In terms of institutional design, in building a system that categorizes workplace employment, the Labor Contract Law makes a breakthrough in workplace labor relations management and sets up an innovative labor relations management system with Chinese characteristics. Faced with the new normal in labor relations, we should make further progress in strengthening democraticenterprise management, optimizing the developmental environment of business, etc.

Measurement of International Competitiveness of Clothing Industry under the Background of Value Chain Reconstruction

Relying on cheap labor cost advantage,China is locked in the low-end processing link of the global value chain and obtains a lower profit share.With the deepening of the international division of labor,changes in the distribution of national interests and the spread of anti-globalization in some developed countries,the global value chain is undergoing a new round of large-scale reconstruction and emerging economies are trying to penetrate and extend to the high end of the global value chain.Based on the theory of industrial upgrading and global value chain,this paper focuses on the current development of Chinese apparel industry,the mechanism,development and problems of global value chain reconstruction,analyzes the relevant elements in the apparel industry value chain reconstruction,and proposes the application of data envelopment analysis(DEA)competitiveness model in the value chain reconstruction of apparel enterprises.We use the CCR(C2R)model to simulate the improvement of production efficiency.Finally,we put forward corresponding countermeasures and suggestions for the value chain reconstruction from the perspective of improving product competitiveness.

An evaluative system for restructuring the literary history of modern China

China is now in an era of multiple values. While there is some virtue in previous theories on the history of literature based on the theory of evolution, class struggle and the enlightenment, when it comes to the twenty-first century, the histories of modem Chinese literature used in teaching are farfrom adequate for meeting the developmental needs of the times, society and literature. This is especially so in view of the putting forward of the goals of ＂putting people first＂ and ＂the harmonious society,＂ and the great changes taking place in time and space, the function of literature and aesthetic taste. Hence there is an urgent need to restructure this history and establish a more fair, equal and reasonable system of evaluation. Such a system would have humanism as its highest principle, and truth, goodness and beauty as its three virtues. Its great superiority would be its functional characteristics of universality, transcendence, fairness, and human-centeredness.
