The main significance of witnesses' appearing in court to testify in criminal trials is that this practice guarantees the defendant's right to confrontation. The issue can thus be framed in another way, as the issue...The main significance of witnesses' appearing in court to testify in criminal trials is that this practice guarantees the defendant's right to confrontation. The issue can thus be framed in another way, as the issue of the appearance in court of the necessary witnesses. Here, the defendant's right to confront is the key point. Since neither China's criminal procedural law nor corresponding judicial interpretations have granted the defendant the right to confront, the rate of appearance of the necessary witnesses amounts in practice to only about twenty- five percent. Criminal trials conducted in the absence of the right to confrontation usually conform to the doctrine of positive substantive truth and manifest a lack of care in conviction and sentencing as well as reliance on a single source of legitimacy in reaching judgments. To correct this state of affairs, it is necessary to institute the right to confront and corresponding safeguards.展开更多
Wireless Power Transfer(WPT)technology can provide real-time power for many terminal devices in Internet of Things(IoT)through millimeterWave(mmWave)to support applications with large capacity and low latency.Although...Wireless Power Transfer(WPT)technology can provide real-time power for many terminal devices in Internet of Things(IoT)through millimeterWave(mmWave)to support applications with large capacity and low latency.Although the intelligent reflecting surface(IRS)can be adopted to create effective virtual links to address the mmWave blockage problem,the conventional solutions only adopt IRS in the downlink from the Base Station(BS)to the users to enhance the received signal strength.In practice,the reflection of IRS is also applicable to the uplink to improve the spectral efficiency.It is a challenging to jointly optimize IRS beamforming and system resource allocation for wireless energy acquisition and information transmission.In this paper,we first design a Low-Energy Adaptive Clustering Hierarchy(LEACH)clustering protocol for clustering and data collection.Then,the problem of maximizing the minimum system spectral efficiency is constructed by jointly optimizing the transmit power of sensor devices,the uplink and downlink transmission times,the active beamforming at the BS,and the IRS dynamic beamforming.To solve this non-convex optimization problem,we propose an alternating optimization(AO)-based joint solution algorithm.Simulation results show that the use of IRS dynamic beamforming can significantly improve the spectral efficiency of the system,and ensure the reliability of equipment communication and the sustainability of energy supply under NLOS link.展开更多

The present study,based on Labov's narrative theory,focuses on how witnesses,involvement affects their narrative reconstruction of the criminal case.Witnesses5 involvement is first subcategorized,and there are two...The present study,based on Labov's narrative theory,focuses on how witnesses,involvement affects their narrative reconstruction of the criminal case.Witnesses5 involvement is first subcategorized,and there are two circumstances concerning their involvements,one being single suspect versus victim(s)crime and the other multiple suspects versus victim(s)crime.The present study takes four witness statements from a single suspect malicious injury case as data to further analyze the effects exerted by different witness involvements on witness statements and their corresponding representations.Results of the analysis indicate that how witnesses are involved in the criminal event exert different effects on witness statements in three aspects as follows:narrative structure,participant distribution,and language strategies.The results of this study further revealed that the more legal responsibility a witness is likely to take for the criminal event,the more transformations he would make in his narrative reconstruction of the crime.展开更多
