Judicial Administration Reform Promotes Human Rights——An interview with Zhang Sujun,Vice-Minister of Justice

Following is a transcript of an interview given to Human Rights by Zhang Sujun, China＇s Vice-Minister of Justice, on how the on-going judicial administration reform promotes the protection of human rights in the country.

From "Criminal on Death Row" to "Acquittal of Charge"——A showcase of China's human rights protection in the administration of justice

In Januaury 1996, a case of murder shocked the seat of Qiaojia County in Yunnan Province. Eight years later, in February 2004, the county town was again astir with the news that the alleged murderer Sun Wangang returned home after being acquitted of the murder charge.

In March 2004, the Second Session of the 10th National People's Congress made amendments to the country's Constitution, writing the clause that 'the state respects and protects human rights' into this fundamental law. This marked a new stage of development of human rights in China. President of the Supreme People's Court and Chief Jus- tice Xiao Yang granted an interview to our staff reporter, reviewing how China has in recent years protected human rights in the administration of justice.

To Actively Perform the Judicial Administration Function and Promote the Development of Cause of Human Rights

Respect for human rights and protection of human rights are significant rules in the Constitution of the People’s Republic of China.In 2015,judicial administration departments at all levels legally exercised their duties,implemented the principles and rules in constitution,and kept strengthening propagation of human rights through creation of contents and methods which had acquired great effects.What they have done contributes significantly toward the development of human rights in China.

Question： Would you elaborate on the progress China has made under the state policy of reform and opening-up in improving the system of administrative litigation？ Answer： Efforts-in this reguard began in 1982, with publication of the Law of Civil Procedures （for trial implementation）.

从教研室考核办法看高校“行政化”的危害

近年来,一些高校以"规范"教师教学行为为理由,依托行政部门的强势地位对教研室实施了全方位的考核。由于考核对象错位、考核内容一刀切、权责利严重脱节等方面的突出问题,使得考核办法更多地体现了行政化背景下权力的意志、意愿与要求。面对考核,教师们感受最多的不是激励,而是管制、约束与诸多的不合理要求。办法的实施严重损伤了教师的职业自豪感和积极进取精神,妨碍了人才培养质量的改善与提高。坚持以服务教学为宗旨,加快高校去行政化进程,努力校正行政部门的工作理念与服务职能,对于高校未来发展至关重要。

中加两国大学管理模式的差异比较及其启示

通过对加拿大大学管理模式的分析比较,发现加拿大在大学管理突出表现在办学经营理念方面,具有明确的产业意识、市场观念和成本核算理念;严谨的治理策略——依法治校,保证了学校在国家、省法律法规的框架内能够独立自主的发展;灵活的运行模式——公立性、独立性与国际化,使高等教育面向社会、公众全方位开放,实现教育的公平公开、多样性和多元化。中国大学经过百年发展,管理模式经过几次重大调整,逐步形成政府管理模式、教育行政化的特点,学习和借鉴加方管理经验,提升中国大学管理水平,扩大大学办学自主权,明确大学法人地位;深化学校内部管理体制改革,平衡行政权力与学术权力;注重大学与社会的关系,建立多元化的办学格局。
