The advent of the big data era has presented unprecedented challenges to remedies for personal information infringement in areas such as damage assessment,proof of causation,determination of illegality,fault assessment,and liability.Traditional tort law is unable to provide a robust response for these challenges,which severely hinders human rights protection in the digital society.The dynamic system theory represents a third path between fixed constitutive elements and general clauses.It both overcomes the rigidity of the“allor-nothing”legal effect evaluation mechanism of the“element-effect”model and avoids the uncertainty of the general clause model.It can effectively enhance the flexibility of the legal system in responding to social changes.In light of this,it is necessary to construct a dynamic foundational evaluation framework for personal information infringement under the guidance of the dynamic system theory.By relying on the dynamic interplay effect of various foundational evaluation elements,this framework can achieve a flexible evaluation of the constitutive elements of liability and the legal effects of liability for personal information infringement.Through this approach,the crisis of personal information infringement in the era of big data can be mitigated,and the realization of personal information rights as digital human rights can be promoted. 展开更多

Finite Element Simulation of Flexible Roll Forming with Supplemented Material Data and the Experimental Verification 被引量:8

Flexible roll forming is a promising manufacturing method for the production of variable cross section products. Considering the large plastic strain in this forming process which is much larger than that of uniform deformation phase of uniaxial tensile test, the widely adopted method of simulating the forming processes with non-supplemented material data from uniaxial tensile test will certainly lead to large error. To reduce this error, the material data is supplemented based on three constitutive models. Then a finite element model of a six passes flexible roll forming process is established based on the supplemented material data and the original material data from the uniaxial tensile test. The flexible roll forming experiment of a B pillar reinforcing plate is carried out to verify the proposed method. Final cross section shapes of the experimental and the simulated results are compared. It is shown that the simulation calculated with supplemented material data based on Swift model agrees well with the experimental results, while the simulation based on original material data could not predict the actual deformation accurately. The results indicate that this material supplement method is reliable and indispensible, and the simulation model can well reflect the real metal forming process. Detailed analysis of the distribution and history of plastic strain at different positions are performed. A new material data supplement method is proposed to tackle the problem which is ignored in other roll forming simulations, and thus the forming process simulation accuracy can be greatly improved. 展开更多

In this paper, a finite element method (FEM)-based multi-phase problem based on a newly proposed thermal elastoplastic constitutive model for saturated/unsaturated geomaterial is discussed. A program of FEM named as SOFT, adopting unified field equations for thermo-hydro-mechanical-air (THMA) behavior of geomaterial and using finite element-finite difference (FE-FD) scheme for so/l-water-air three-phase coupling problem, is used in the numerical simulation. As an application of the newly proposed numerical method, two engineering problems, one for slope failure in unsaturated model ground and another for in situ heating test related to deep geological repository of high-level radioactive waste (HLRW), are simulated. The model tests on slope failure in unsaturated Shirasu ground, carried out by Kitamura et al. (2007), is simulated in the framework of soil-water-air three-phase coupling under the condition of constant temperature. While the in situ heating test reported by Munoz (2006) is simulated in the same framework under the conditions of variable temperature hut constant air pressure. 展开更多

A micromechanics constitutive theory which takes into account both the dilatation and shear ef- fects of the transformation is proposed to describe the macroscopic plastic behavior of structure ceramics during forward transformation under different temperatures.Under some basic assumptions,the analytic expressions of the Helmholtz and complementary free energy of the constitutive element are derived in a self-consistent manner by using the Mori-Tanaka's method which takes into account the interaction between the transformed inclusions.In the framework of Hill-Rice's internal variable constitutive theory,the forward transformation yield function and incremental stress strain relations,in analogy to the theory of metal plasticity,for non-proportional loading histories are obtained. 展开更多

The polyurethane, which was the subject of the constitutive research presented in the paper, was based on oligocarbonate diols Desmophen C2100 produced by Bayer?. The constitutive modelling was performed with a view to applying the material as the inlay of intervertebral disc prostheses. The polyurethane was assumed to be non-linearly viscohyperelastic, isotropic and incompressible. The constitutive equation was derived from the postulated strain energy function. The elastic and rheological constants were identified on the basis of experimental tests, i.e. relaxation tests and monotonic uniaxial tests at two different strain rates, i.e. λ= 0.1 min-1 and λ= 1.0 min-1. The stiffness tensor was derived and introduced to Abaqus?finite element(FE) software in order to numerically validate the constitutive model. The results of the constants identification and numerical implementation show that the derived constitutive equation is fully adequate to model stress-strain behavior of the polyurethane material. 展开更多
