Digital Human Rights from the Perspective of System Theory——Concept Definition, Social Function, and Constitutional Basis

The three core issues in the“digital human rights”debate are whether“digital human rights”are possible,necessary,and feasible.Both sides of the debate focus on discovering the value of“digital human rights”to individuals from a semantic level,but ignore the significance of“digital human rights”to the whole society and its subsystems at the level of social structure.By introducing Niklas Luhmann's System Theory,this observation blind spot can be eliminated.Fundamental rights are devoted to directly shaping not a physiological-psychological“individual”as a social environment but a social“person”that can be included by social systems.It is clear that digital human rights are the right to participate in digital communication of a“human”as a“person”,so they are possible in terms of conceptual definition.Digital human rights can help“people”lower the threshold for participation in digital communication,limit the excessive expansion of social systems,and promote the free and complete expression of body and mind,so they are necessary for social functions.There are limitations in the existing two ideas of“incorporating digital human rights into the constitution”.Based on the new construction idea of System Theory of Law,digital human rights as the right to participate in digital communication can be typified into digital communication in social sub-fields such as politics,economy,science,and art.The right to participate constructs a complete digital human rights system,making it feasible on the basis of the constitution.

Impact of applying the theory of human becoming and self-care deficit theory of nursing on insomnia in after stroke urinary incontinence patients

Objective:To determine the impact of applying the theory of human becoming and self-care deficit theory of nursing in overcoming insomnia in patients of urinary incontinence(UI)after stroke.Insomnia is a sleep disorder experienced by UI patients after stroke which can exacerbate problems related to brain damage and can complicate the recovery process.Methods:This study was a quasi-experimental conducted in 4 hospitals.Fifty-six patients were selected by convenience sampling and divided into 2 groups(the intervention and control group).Participants in the intervention group received“applying the theory of Human becoming and self-care deficit theory of nursing,”starting when the patient is about to go home from the hospital and continuing at the house.Measurement of insomnia is done using the Pittsburgh Sleep Quality Index(PSQI).Results:The mean insomnia scores of participants from both groups increased in the first and third measurements.The second and third insomnia measurements found a significant difference(P<0.001).This intervention decreased the average score of insomnia by 4.11 times in the second measurement and 5.82 times in the third measurement.The most important item that decreased in the third measurement of insomnia was sleep efficiency.Conclusions:Applying the theory of human becoming and self-care deficit theory of nursing in this study significantly decreased the insomnia score of post-stroke UI patients.It can be used as a guide for nurses,patients,and families in managing insomnia.In addition,the application of nursing theory in nursing practice can systematize nursing care plans and organize the knowledge of professionals into a conceptual framework,as well as provide effective guidance for nurses on what to do.

On The Research of Foreign and Domestic Human Capital Theory

Human Capital Theory came into being in the middle and later periods of the 20th century. A lot of achievements have been made on the research in its connotation, measures of the value, investment and income, function mechanism and so on, by foreign scholars. In recent 10 years of the new Millennium alternation, the "steal business effect" and the structure of human capital on the mechanism of economic rise has become the two emphasis in current foreign Human Capital Theory’s research. On the basis of foreign researches and Chinese situations, domestic scholars have enriched and developed it, but there are many disparities in its methods, aspects and levels between foreign and domestic researches.

The Evolution of Theory of Mind in the Human Evolution

Despite almost half a century of research for theory of mind, its evolutionary origin is largely unknown. This paper proposes that the evolutionary origin of theory of mind starts from the beginning of the human evolution to form hominins through bipedalism and the mixed habitat. The feet of the early hominins were still adapted for grasping trees rather than walking for long distances and running fast on the ground. The early hominins lived in the mixed habitat of grassy woodland with patches of denser forest, and freshwater springs. The difficulty of walking in the mixed habitat leads to division of labor for the home specialist group (small children, old people, and mothers with small children, and pregnant women) in the safe forest area and the exploration specialist group (young people without the care of small children) in the dangerous open area. The different tasks, attitudes, and mentalities in different specialist groups produce theory of mind as the ability to attribute different mental states to different specialist groups. (Uniformity of mind instead of theory of mind is for generalists without division of labor). The early Homo species with the open habitat developed theory of mind for hunter specialist group and gatherer specialist group. The middle Homo species with complex stone tools developed theory of mind for the cooperative specialist groups in the large production of complex stone tools. The late Homo species with complex social interaction developed theory of mind for mind reading to enhance cooperation and to detect cheaters in complex social interaction. For religion, the unusually harsh Upper Paleolithic Period developed theory of mind for imaginary specialists in terms of supernatural power, guidance, and comfort. Therefore, the three general types of theory of mind are for specialists in division of labor, mind reading in complex social interaction, and imaginary specialists in imaginary division of labor under harsh conditions. Self-awareness in the mirror self-recognition test is also explained.

This year marks the 90th anniversary of the found- ing of the Communist Party of China （CPC）. As Party General Secretary Hu Jintao said, for the past 90 years, under the leadership of the CPC, the Chinese people have accomplished the three missions of New Democratic Revolution, the Socialist Revolution and reform and opening-up. During the process, the Party and the people have opened a new path of socialism with Chinese characteristics, formed the theory of socialism with Chinese characteristics, as well as established a system of socialism with Chinese characteristics.

A graph theory model using human nature structure

A graph theory model of the human nature structure( GMH) for machine vision and image/graphics processing is described in this paper. Independent from the motion and deformation of contours,the human nature structure( HNS) embodies the most basic movement characteristics of the body. The human body can be divided into basic units like head,torso,and limbs. Using these basic units,a graph theory model for the HNS can be constructed. GMH provides a basic model for human posture processing,and the outline in the perspective projection plane is the body contour of an image. In addition,the GMH can be applied to articulated motion and deformable objects,e. g.,in the design and analysis of body posture,by modifying mapping parameters of the GMH.

The design of this paper is to present the first installment of a complete and final theory of rational human intelligence. The theory is mathematical in the strictest possible sense. The mathematics involved is strictly digital—not quantitative in the manner that what is usually thought of as mathematics is quantitative. It is anticipated at this time that the exclusively digital nature of rational human intelligence exhibits four flavors of digitality, apparently no more, and that each flavor will require a lengthy study in its own right. Human Care Theory and Influences on the Life Quality Index of Cancer Patients in Household Life

To investigatetheinfluences of the application of human care theory on the life quality and happiness of cancer patients after they receiveda community nursing care which was implemented by the human care theory. The quality life and the happiness index of 93 patients with cancer living in the six communities in Jillin were assessed, the assessment of the life quality was based on a life quality scale (SF-36) and that of the happiness index was based on Memorial University of Newfoundland Scale of Happiness (MUNSH). The community nurses cared for these patients by applying the theory of human care and the life quality and the happiness index of the patients were observed after the care. The results showed that there were significant differences in the score of 5 dimensions in the eight dimensions of the life quality between before the care and after the care (<0.05), and there were significant differences in the average sores of the positive emotion, positive experience, negative emotion, negative experience and level of happiness included in the happiness index between before the care and after the care (<0.05), suggesting that the theory of human care can be used for the care of patients with cancer and the application of the theory can effectively improve the life quality and the happiness index of the patients, strengthen their problem-solving abilities and let them have a positive attitude towards their lives.

Stages, Content, and Theory of Strategic Human Resource Management （SHRM）： An Exploratory Study

This study discusses ＂theory of strategic human resource management （HRM） has an impact on research topic of this study is to discuss SHRM resource management （SHRM）＂. Theory of SHRM is that human firm performance through employee performance. Therefore, the theory. Research method is literature scanning. Research findings are, firstly, that strategic HRM can be defined with employee/firm performance relationship. Secondly, this study depicts its own SHRM model. In this model, HRM practices develop individual performance of employees in organizations, and individual performance increases performance of business departments, such as supply department, finance department, marketing department, logistics department, etc., and performance of business departments has an impact on firm performance. Furthermore, this study makes its SHRM definition. So far, there have been two definitions of SHRM in literature studies. The first definition identifies SHRM with corporate strategies and competitive advantage. The second definition describes SHRM with HRM-firm performance relationship. This study makes the third definition, namely, SHRM is employee/firm performance relationship, and this definition is figured in an SHRM model in this study.

An Evaluation of the Core Controversies in Contemporary Western Human Rights Theory——A Study Based on the Examination of the Criterion of Fidelity to Practice

The development of theories on human rights with Chinese characteristics and China’s engagement in global human rights governance cannot be separated from attention to contemporary Western human rights theory.The debate between naturalistic and political conceptions of human rights has a long history,but discussions on the basic criteria for evaluating human rights theories have been insufficient.This article,focusing on the criterion of fidelity to practice,attempts to identify the development trajectory and direction of human rights theory.The universal claims of naturalistic human rights perspectives and the human rights catalog they propose have been criticized for deviating from practice.On the other hand,political conceptions of human rights,while emphasizing domestic human rights practices,have been criticized for their occasional nature and perceived loss of criticality.The broad-way practice theory seeks a third way that goes beyond the divide between these two perspectives.On the one hand,the theory itself faces limitations and the need for reshaping,while on the other hand,the traditional singular practice theory is also undergoing self-renewal.It can be said that the“internal critique”of contemporary Western human rights theory is already underway and will continue.

Bibliometrics analysis of Jean Waston’s Human caring theory in China in the past 10 years

Aims:To analyze the research status and development trend of human caring theory in the field of nursing in China,and to provide better reference for theory and research.Methods:All articles related to human caring theory were searched in the China national knowledge infrastructure(CNKI),Wanfang Data and VIP database which were published in the past year was searched.NoteExpress document management software and Excel software were used to conduct bibliometrics analysis on the annual distribution,regional distribution,journal distribution,fund support and research content of the documents.The search time was from 1 January 2009 to 31 December 2009.Results:A total of 113 articles were included in the literature.The total number of published articles showed a slow and tortuous trend.After 2013,the volume of publications was relatively stable.The core journals accounted for 17.7%of the total number of articles,and most of them came from hospitals.The research covers clinical applications,nursing education,nursing management and other fields.Conclusion:Human caring theory is an important part of nursing theory,Nursing researchers in China can conduct clinical research,nursing management and nursing education research based on their theoretical connotation,combined with clinical and teaching environment.

Summary of the Seminar on “70 Years of the PRC’s Human Rights: Path, Practice and Theory”

The seminar"70 Years of the Prc’s Human rights:Path,Practice and Theory",sponsored by the china Society for Human rights Studies and the Publicity Department of the c Pc Jilin Provincial committee and organized by Human rights research center of Jilin university,was held at Jilin university on May 9,2019.More than 100 officials,experts and scholars from state organs,universities and research institutions attended the seminar.The seminar focused on the historical development experience of the cause of human rights in china over the past seven decades since the founding of the People’s republic of china(Prc),as well as china’s human rights practices and theories and the promotion of human rights diplomacy and china’s right to speak on international human rights.The seminar was conducive to further understanding the development progress of human rights in the People’s republic of china,building consensus on human rights,and promoting the integrity and innovation of theoretical research on human rights.

In 1978, academia broke through the theoretical forbidden zone with the slogan of "equality before the law" and initiated a great discussion on some important legal issues including legal equality. During the past 40 years since the reform and opening-up, the relevant research has changed from the ideological contention deeply influenced by class discourse to the abstract theoretical research where class discourse has been fading away, and then turn to the technical and concrete practical research. The China Society of Human Rights Studies and the Human Rights Research Center at Nankai University jointly hosted a seminar on"The 10th Anniversary of the Blue Book on Human Rights and the Chinese Human Rights Concept,Discourse and Theory"on December 19th,2020.Experts at the meeting expressed their views and discussed the organization,style,and system of the Blue Book on Human Rights;the concept,expression,and dissemination of the Chinese human rights discourse;the paradigm,principle,and structure of the Chinese human rights theory;and the objectives,paths,and development of the Chinese human rights enterprise.

An Improved CREAM Model Based on DS Evidence Theory and DEMATEL

Cognitive Reliability and Error Analysis Method(CREAM)is widely used in human reliability analysis(HRA).It defines nine common performance conditions(CPCs),which represent the factors thatmay affect human reliability and are used to modify the cognitive failure probability(CFP).However,the levels of CPCs are usually determined by domain experts,whichmay be subjective and uncertain.What’smore,the classicCREAMassumes that the CPCs are independent,which is unrealistic.Ignoring the dependence among CPCs will result in repeated calculations of the influence of the CPCs on CFP and lead to unreasonable reliability evaluation.To address the issue of uncertain information modeling and processing,this paper introduces evidence theory to evaluate the CPC levels in specific scenarios.To address the issue of dependence modeling,the Decision-Making Trial and Evaluation Laboratory(DEMATEL)method is used to process the dependence among CPCs and calculate the relative weights of each CPC,thus modifying the multiplier of the CPCs.The detailed process of the proposed method is illustrated in this paper and the CFP estimated by the proposed method is more reasonable.

Application of Incentive Theory in Hospitals' Human Resource Management

In recent years,the modem medical system has achieved deepening reforms,and the management systems of domestic hospitals have changed accordingly,which has improved the level of modem management to a certain extent.However,the development of hospitals is easily affected by many factors,which gradually highlights the problems of internal human resource management.This is not conducive for improvement in terms of the enthusiasm and initiative of internal employees in addition to restricting the quality of medical services.Based on this,in hope to provide assistance,this article uses incentive theory as the main research object and focuses on its specific application in hospitals*human resource management.
