This paper discusses the impact of e-governance powered by blockchain in the project and program management industry. With the rise in technological innovations, many countries have turned to e-governance for efficiency in service delivery, transparency, and decision-making. E-governance backed by blockchain technology entails improving the public services provision by implementing structures of information and communication technologies. There are many challenges with the traditional project management approach that causes organizations and its stakeholders’ cost and time. Thus, the introduction of blockchain has given many organizations a new approach to adopt in order to eliminate the challenges associated with the typical project management approach. In spite of the cutting-edge technology of blockchain and its broad applications in program management and e-governance, there are still many challenges that restrain its adoption on a broader scale. The research discusses the challenges of the blockchain deployment in the program management field and e-governance in private and government sectors and it highlights the efforts put by both sectors to make use of the technology. Also, the research covers the opportunities and the advantages of a blockchain adoption in various segments. The paper uses various case studies in the UAE, in both private and government sectors, and a qualitative research approach was implemented. The case studies were on government entities such as Smart Dubai and the Ministry of Health Prevention and also private entities like DP World and Emirates NBD. The paper concludes with recommendations and solutions on how to maximize the benefit of blockchain in the program management industry and how it is improving the decision-making process. 展开更多

[目的/意义]突发事件为我国带来的危机层出不穷,如何以国家安全与发展需求为目标导向,有效化解国家安全风险是当务之急。然而情报在突发事件的应急决策工作中发挥着重要作用。[方法/过程]以韧性理论为顶层指导,以情报决策相关概念为基础,以政府为决策主体,梳理突发事件研究方向相关文献,构建基于韧性理论的突发事件情报决策体系。从情报流、业务流、决策流三条链路为线索,纵向刻画出体系的管理流程与运行逻辑。[结果/结论]以数据驱动、知识驱动为内在推动力,将韧性、情报注入决策体系,给突发事件的决策赋予了更高层次的智能性、智慧性,完善了突发事件应急管理的体系建设工作,为政府优化政策战略提供参考,使政府治理更具弹性与兼容性。 展开更多

Network governance, widely used as theoretical model in investigations on social housing, is not free from critiques, first of all, for the fact that it has a uni-directionality of bottom-up processes, when oriented to public deliberation, or top-down when decision-makers are technical experts at the political level. Given the new complexity of the social housing issue and the considered limits of the network governance, this work aims at looking for a possible different theoretical framework able to give different tools to simplify decision making processes without any alteration of any basic decisional element. The contribution given by this work is the proposition of what has been called "fluent governance" as a framework of decision making able to represent the whole spectrum of interventions in the process, also taking into account aspects not captured by standard models. The paper reports an experimentation of the proposed model conducted in Italy in the field of renovating social housing policy. 展开更多

Unjust Decision Making Resulting in Marginalization of the Powerless Prostitution Community in Silir-Semanggi of Solo

The city government of Solo has made a decision that street vendors operating in the city's Revolution Monument in Banjarsari Square for years must be relocated to the new built traditional market, called Pasar Notoharjo. This study utilized ethnographic methods, a combination of methods including observation, in-depth interview, focus group and the unobtrusive method including collecting written information. The study showed that the decision of Solo city government which tended to privilege street vendors' interests resulted in the life chance of prostitution was deteriorated and marginalized. The city government has accommodated street vendors' demand to remove ,the organized prostitution community operating in Silir-Semanggi of Solo since 1960s as one of requirements for their relocation to this area, where the new built traditional market with more than one thousand kiosks was provided for street vendors. The procuresses' demand to obtain their rights of the land they occupied for more than 20 years on behalf of their legal ownership failed due to administrative, bureaucratic and legal obstacles. Prostitutes were inhumanly chased away by the city government apparatuses in collaboration with the police from the site of operation in 2006 and it resulted that the social and economic lives of procuresses and prostitutes got worse since their prostitution activities in this location were totally forbidden and unfinished. Both procuresses and prostitutes were marginalized because they did not have links to the powerful stakeholder who were able to protect their rights. Their health was in danger because the city government's concern to their activities was limited in particularly since 1998 when the location was formally closed by Solo mayor of the new order. 展开更多

In the context of renewed interest in collaboration in natural resource management,the collaborative governance approach has lately been introduced to the forest Protected Areas(PAs)in Bangladesh.The adoption of this co-management approach is seen as an attempt to influence the governance process towards a transformation from the conventional custodian system to a more participatory management regime.Recognition of rights and responsibilities,effective participation,and equitable distribution of benefits amongst the key stakeholders working under a facilitative policy and legal framework are believed to address the broader goals of sustainable development Notwithstanding the resurgence of interest in governance of forest PAs through the co-management approach,academic research on the subject remains limited.This article attempts to review selected key information and milestones on the forest PAs governance with special reference to the major policies and legal documents.With a brief introductory section,this article focuses on the genesis and selected major features of the Forest PAs in the country.The discussion then dwells on the policy and legal framework and provides a critique on its relevance for promoting community participation.The existing institutional arrangements for community engagement in protected area governance are also analyzed in light of the national and international commitment and policy obligations on the part of the country.The salient observations and key findings of the study include the following:(1)despite its limitations,comanagement as concept and practice has gradually taken roots in Bangladesh;(2)the degree and level of active community participation remain low and limited,and there is also clear weakness in conscientizing and orientating the local community on the key legal and policy issues related to PA governance in the country;and(3)policy makers,practitioners,and other local stakeholders related to PA governance need to be oriented on international commitment and national development strategies.The study calls for systematic focus on regular research on the performance of co-management in the country,and efforts towards improving the implementation mechanisms in the field. 展开更多

基层政府、人民法院、乡村自治主体形塑了乡村治理共同体。乡村治理共同体内部理应呈现出的行政行为介入规范自治、司法权力嵌入保障私权、自治主体纠偏回归法治等预设样态,是农民集体决议法治化的应然图景。然而,行政行为偏差、司法裁... 基层政府、人民法院、乡村自治主体形塑了乡村治理共同体。乡村治理共同体内部理应呈现出的行政行为介入规范自治、司法权力嵌入保障私权、自治主体纠偏回归法治等预设样态,是农民集体决议法治化的应然图景。然而,行政行为偏差、司法裁判冲突、自治秩序混乱等治理乱象表明,治理共同体内部存在的行政机关权责失衡、司法机关审理规则不明、自治主体落实约束制度缺位,已然成为农民集体决议法治化面临的现实困境。立足于村民自治与国家法治的融合发展,以细化权责清单、统一司法规则、完善制度保障为依托,厘清行政机关介入农民集体决议事项的权力限度与责任范围、明确司法机关处理农民集体决议纠纷的案由类型与撤销权客体、强化自治主体重作农民集体决议的内部约束与司法约束,是农民集体决议法治化的重要路径。 展开更多

算法嵌入政府环境治理的正向效应、潜在风险与规制路径

与传统的政府环境治理模式相比,政府运用算法开展环境治理具有明显的正向效应:能够提升环境治理的精准性、预测性和高效性。算法嵌入政府环境治理的过程容易引发伦理、工具和法治三个维度的风险。伦理维度中面临价值失衡风险,工具维度... 与传统的政府环境治理模式相比,政府运用算法开展环境治理具有明显的正向效应:能够提升环境治理的精准性、预测性和高效性。算法嵌入政府环境治理的过程容易引发伦理、工具和法治三个维度的风险。伦理维度中面临价值失衡风险,工具维度中包含环境数据结构性不足、环境算法模型透明度不足的风险,法治维度中则存在环境算法模型掌控者权力滥用和责任分配不均的风险,故有必要对算法嵌入政府环境治理所诱发的风险建构系统性的法律规制体系,从而充分发挥算法自动化决策的环境治理优势。在规制路径的选择上,应当立足于宏观基本原则指引和具体规制方案设计两个方面,对算法嵌入政府环境治理的潜在风险进行系统规范:宏观层面上,算法嵌入政府环境治理应该遵循依法治理、公平正义、浮动比例和正当程序的基本原则。在具体的规制方案上,既要建立算法嵌入政府环境治理的支持结构,以发挥算法嵌入政府环境治理的优势,又要根据算法本身的漏洞,进行适当的规则变动,从而通过“支持性结构和适应性流变相平衡”的方式,提升具体规制方案的可行性。在具体规制方案的架构上,应秉持全过程治理的视角,实现事前预防、事中监管和事后归责相统一:在事前预防部分,要求算法嵌入政府环境治理能够切实符合伦理要求,建立完善的环境数据核准、反馈和保护机制以及环境算法模型的解释机制。在事中监管部分,应当建立算法嵌入政府环境治理的部门、社会组织和社会公众监管制度。在事后归责部分,需要压实算法嵌入政府环境治理的责任分配制度。 展开更多

从重大突发事件应对的视角出发,探索智慧政府情报决策效果的内涵与特点,并分析智慧政府情报决策效果的影响因素及其条件变量组合路径,有利于决策效果的优化与重大突发事件的妥善应对。以安全系统理论与物理-事理-人理(wuli-shili-renli,... 从重大突发事件应对的视角出发,探索智慧政府情报决策效果的内涵与特点,并分析智慧政府情报决策效果的影响因素及其条件变量组合路径,有利于决策效果的优化与重大突发事件的妥善应对。以安全系统理论与物理-事理-人理(wuli-shili-renli,WSR)方法为指导,通过大量文献调研与分析界定政府情报决策效果的内涵与特点,同时梳理影响政府情报决策效果的条件变量,采用问卷调查收集相关数据,再利用模糊集定性比较法详尽分析其影响因素与条件变量组合路径。通过研究决策信息焦虑、情报传递障碍、突发事件网络舆情、突发事件应急响应、信息基础设施建设、法律法规与制度建设等不同变量组态对智慧政府情报决策效果的影响,最终得到5条组合路径,即情报传递障碍缺失型路径、事理因素主导的信息焦虑因素与法规制度因素融合型路径、信息焦虑缺失型路径、事理因素主导的情报传递障碍因素与法规制度因素融合型路径以及法规制度特化型路径。这些条件变量组合路径可以为智慧政府情报决策提升与突发事件应对提供参考。 展开更多
