The innovative models cover buying shares of contract management rights,transforming from farmers to townspeople and mortgaging contract management rights. The plights exist in the reform are analyzed,among which the plights of buying shares of contract management rights are introduced from the following five aspects:the conflict with the present land contract laws,the possible new round of massive scale land loses,the confounded functions of government and enterprise caused by risk transference and the difficulties of handling assets when the contract management rights expired. Besides,the plights of the transforming from rural residents to urban residents are analyzed from four aspects,which include the particularity of reform,high financial pressure,emergence of interbedded people and difficulties of payoff of village-based companies. From the facets of limited mortgage area,risks of reimbursing the loan,legal risks of mortgage. The results show that the stock purchasing model of contractual management rights reveals the capital value of land and the model is of theoretical and practical significance in law and economics. However,the social security system is not perfect,so the stock purchasing model of contractual management rights can not be expanded. In addition,the participation of more famers and the expansion of enterprises are limited as well. The land comprehensive reform model of transforming from rural residents to urban residents is of positive significance to the comprehensive exploration of farmland property system reform,but this kind of model should be supported by strong economy. The stock purchasing model of contractual management rights is of significance to perfect the contractual management rights,but it conflicts with the existing laws and financial systems.展开更多

The intellectual property (IP) benefits allocation is a major problem in collaborative innovation, because the collaborative partners have different benefits pursues, and they make the allocation of ownership and bene...The intellectual property (IP) benefits allocation is a major problem in collaborative innovation, because the collaborative partners have different benefits pursues, and they make the allocation of ownership and benefits complicated. If the interests can’t be allocated properly, then the conflicts will occur between the collaborative partners and collaborative relationship can’t last long, so we focus on the benefits allocation mechanism of IP to ensure each participated partner can get the benefits fairly. Some scholars noticed the importance of IP benefits allocation and conducted theoretical research, which provided model and theoretical analysis, but these research contents were not comprehensive, the research methods and evidences seemed inadequate, which leaded the conclusions into?having limited meaning. Thus, we use case study and investigate regional-development oriented collaborative innovation center to examine the benefits allocation mechanism. We find out the problems in the existing benefits allocation mechanism, such as the compensation and rewards are not enough, the benefits allocation should be fair, the payment way is not various and so on. Based on the case study on the status quo and combined with related needs, we put forward that ensure the ownership of IP, attention on regulation construction, benefits protection and so on. Knowledge of the soil phys...Collapsing gully erosion is a specific form of soil erosion types in the hilly granitic region of tropical and subtropical South China, and can result in extremely rapid water and soil loss. Knowledge of the soil physical and chemical properties of farmland influenced by collapsing gully erosion is important in understanding the development of soil quality. This study was conducted at the Wuli Watershed of the Tongcheng County, south of Hubei Province, China. The aim is to investigate soil physical and chemical properties of three soil layers (0-20, 20-40 and 40-60 cm) for two farmland types (paddy field and upland field) in three regions influenced by collapsing gully erosion. The three regions are described as follows: strongly influenced region (SIR), weakly influenced region (WIR) and non-influenced region (NIR). The results show that collapsing gully erosion significantly increased the soil gravel and sand content in paddy and upland fields, especially the surface soil in the SIR and WIR. In the 0-20 cm layer of the paddy field, the highest gravel content (250.94 g kg-1) was in the SIR and the lowest (78.67 g kg-1) was in the NIR, but in the upland filed, the surface soil (0-20 cm) of the SIR and the 40-60 cm soil layer for the NIR had the highest (177.13 g kg-1) and the lowest (59.96 g kg-1) values of gravel content, respectively. The distribution of gravel and sand decreased with depth in the three influenced regions, but silt and clay showed the inverse change. In the paddy field, the average of sand content decreased from 58.6 (in the SIR) to 49.0% (in the NIR), but the silt content was in a reverse order, increasing from 27.9 to 36.9%, and the average of the clay content of three regions showed no significant variation (P〈0.05). But in the upland filed, the sand, silt and clay fluctuated in the NIR and the WIR. Soils in the paddy and upland field were highly acidic (pH〈5.2) in the SIR and WIR; moreover lower nutrient contents (soil organic matter (SOM), total N and available N, P, K) existed in the SIR. In the 0-20 cm soil layer of the paddy field, compared with the NIR and the WIR, collapsing gully erosion caused a very sharp decrease in the SOM and total N of the SIR (5.23 and 0.56 g kg-1, respectively). But in the surface soil (0-20 cm) of the upland field, the highest SOM, total N, available N, available P and available K occurred in the NIR, and the lowest ones were in the SIR. Compared with the NIR, the cation exchange capacity (CEC) in the SIR and WIR was found to be relatively lower. These results suggest that collapsing gully erosion seriously affect the soil physical and chemical properties of farmland, lead to coarse particles accumulation in the field and decrease pH and nutrient levels.展开更多

In this developing ecosystem, the optimized fertilizatio...Increased food demand from the rapidly growing human population has caused intensive land transition from desert to farmland in arid regions of northwest China. In this developing ecosystem, the optimized fertilization strategies are becoming an urgent need for sustainable crop productivity, efficient resources use, together with the delivery of ecosystems services including soil carbon(C) and nitrogen(N) accumulation. Through a 7-year field experiment with 9 fertilization treatments in a newly cultivated farmland, we tested whether different fertilizations had significant influences on soil C and N accumulation in this developing ecosystem, and also investigated possible mechanisms for this influence. The results showed that applying organic manure in cultivated farmland significantly increased the soil C and N accumulation rates; this influence was greater when it was combined with chemical fertilizer, accumulating 2.01 t C and 0.11 t N ha^(–1) yr^(–1) in the most successful fertilization treatment. These high rates of C and N accumulation were found associated with increased input of C and N, although the relationship between the N accumulation rate and N input was not significant. The improved soil physical properties was observed under only organic manure and integrated fertilization treatments, and the significant relationship between soil C or N and soil physical properties were also found in this study. The results suggest that in newly cultivated farmland, long term organic manure and integrated fertilization can yield significant benefits for soil C and N accumulation, and deliver additional influence on physical properties.展开更多

Concretely: The paper goes from: AI (Artificial Intelligence)—to the related IP (Intellectual Property) domain—to the relevance of EI (Emotional Intelligence);thus, forming the new AI-IP-EI Trilogy and its attributes and specific impacts to the new innovation process, and business model dimensions. These impacts are outlined and illustrated in part in essays of specific sections and all along. Several concrete study cases are used in the various dedicated sections;such as cases respective to the inventor status, and the EI factor, to the sport education innovative dimension, as well as to biases as inevitably promoting and revealing, to drastically enlarge open innovation supported by constructivism and creations of musical group as a model of open reflexive education. Overall resulting adapted business models appear to have a massive potential, and a multidimensional reach with a necessary attention to the IP policy on going definition. The durable green dimension is exemplified as well. Definitely, and will remain an opportunity, all along the 4IR quantum game changer to come. Neither seeking an in-depth expert analysis, nor a grand public over-simplified bavardage, of the trilogy, AI-IP-EI, four authors here propose an illustrated view of scientific, educational, visionary, demonstrative value to the subject matter. They are aged about 30-40-50-60, being IP & Innovation strategist, future IP lawyer, children-teacher and professional academy sport coach, illustrator and bio-advanced materials engineering “Fellow Scientist”. With experience of large and smaller organizations, being involved innovators, inventors and private artists as well, they are sharing their “non-jargonized down-to-earth”, forward looking views through a structured analysis of the trilogy using realistic examples and data from rather diverse specialized independent sources, biotechnology, nanomaterials, sport… New invention and inventorship is been “reconceptualized” at least from an “insighter or insider” viewpoint, and sport team approach more broadly revisited from its academy level to its commercial asset impact, via educational virtues and values. Nonetheless, the IP associated with AI remains still barely covered in scientific publications. Especially patent discussion tends to be rather a legal matter. Another trilogy, 2013, “Business Strategy-IP Strategy-R&D Strategy: An All-in-One Business Model” proposed by the author, marked the advent, and customized implementation of a new strategy level. After the two trilogies’ volumes, the AI-IP “accessibility” chapter was a logical step brought to the attention of a larger public by the author. The time now to bring to light another chapter, namely the IP eligibility of AI innovation steps in ad hoc inventions. The main objectives of this short, principally illustrated communication, are to: 1) Revise the best mode requirement status, i.e. the best way to enable the reproducibility of claimed matter, reviewing its need for improvement when AI is involved. 文摘Through a series of duly cited, and quoted (“–”), excerpts, originating mostly from two Technology Trends reports, WIPO (2019), WIPO (2021), an attempt to establish a pseudo dialog is proposed, in order to surface a few questions accessible to a larger public of innovators, who may have an interest in the IP accessibility dimension using Frontier Technologies (such as AI, IoT, 3D…). AT, Assistive Technology, is instrumental as a uniquely faceted example. The illustrations’ section extends the consideration and integration of additional “traits” of the field of interest and related. Intuitive answers are “reachable” and further literature is provided on the relevant matters and connected. The emphasis is on educational, illustrative and demonstrative value.
文摘The intellectual property (IP) benefits allocation is a major problem in collaborative innovation, because the collaborative partners have different benefits pursues, and they make the allocation of ownership and benefits complicated. If the interests can’t be allocated properly, then the conflicts will occur between the collaborative partners and collaborative relationship can’t last long, so we focus on the benefits allocation mechanism of IP to ensure each participated partner can get the benefits fairly. Some scholars noticed the importance of IP benefits allocation and conducted theoretical research, which provided model and theoretical analysis, but these research contents were not comprehensive, the research methods and evidences seemed inadequate, which leaded the conclusions into?having limited meaning. Thus, we use case study and investigate regional-development oriented collaborative innovation center to examine the benefits allocation mechanism. We find out the problems in the existing benefits allocation mechanism, such as the compensation and rewards are not enough, the benefits allocation should be fair, the payment way is not various and so on. Based on the case study on the status quo and combined with related needs, we put forward that ensure the ownership of IP, attention on regulation construction, benefits protection and so on. We hope this study can solve these problems through case analysis, and benefit to maintain collaborative relationship.

文摘Wuling Mountain Area of Hubei Province is a key tea-producing area in China,and the tea industry is its agricultural pillar industry.First,this paper introduces the tea industry in Wuling Mountain Area.Then,from traditional knowledge,biological genetic resources,new plant varieties,patents,geographical indications,trademarks,etc.,it studies the intellectual property resources of its tea industry.Next,it analyzes main problems of its intellectual property protection and inheritance,innovation and development.It also discusses the strategy of inheritance,innovation and high-quality development of the tea industry in this ethnic area in the context of the strategy of strengthening the country with intellectual property rights and the strategy of rural revitalization.Finally,it comes up with pertinent recommendations,including implementing the traditional tea production process and technical protection project,protecting the biological genetic resources of tea trees,cultivating new varieties of tea plants bred independently,creating high value patents,building regional public brands,and strengthening intellectual property protection.

文摘[Objective]The research aimed to understand the change rules of physicochemical properties of soil in the different modes of returning farmland to forest.[Method]The physicochemical properties of soil in three different types of returning farmland to forest(Hippophae rhamnoides Linn.forest,Caragana korshinskii forest and Ulmus pumila L.forest)were analyzed by taking the enclosed grassland as comparison in Bashang area of northern Hebei Province.[Result]The results showed that there were significant differences among different types.Order of the bulk density of soil:H.rhamnoides Linn.forest(1.17 g/cm^3)<U.pumila L.forest(1.24 g/cm^3)<C.korshinskii forest(1.26 g/cm^3)<enclosed grassland(1.61 g/cm^3);order of the total porosity of soil:H.rhamnoides Linn.forest(55.29%)>U.pumila L.forest(52.55%)>C.korshinskii forest(51.93%)<enclosed grassland(38.85%);order of the organic matter content of soil:H.rhamnoides Linn.forest(3.191%)>C.korshinskii forest(3.128%)>U.pumila L.forest(2.804%)>enclosed grassland(2.536%).[Conclusion]After returning farmland to forest,vegetation played a positive role in physicochemical properties of soil.There were significant differences in physicochemical properties of soil among different modes of returning farmland to forest,and the improvement effect of H.rhamnoides Linn.forest on physicochemical properties of soil was the best.

This article introduces the new concept of "intellectual-property-rights-ization", and discusses about the role and importance of this concept; a country that has normalized intellectual property rights are characterized by a people that realize the importance of intellectual property rights, a presence of a rule system that protects one 's intellectual property, an administration that regulates intellectual property rights, a specialization of labor in protecting IPR, and a strong education system.

文摘Collapsing gully erosion is a specific form of soil erosion types in the hilly granitic region of tropical and subtropical South China, and can result in extremely rapid water and soil loss. Knowledge of the soil physical and chemical properties of farmland influenced by collapsing gully erosion is important in understanding the development of soil quality. This study was conducted at the Wuli Watershed of the Tongcheng County, south of Hubei Province, China. The aim is to investigate soil physical and chemical properties of three soil layers (0-20, 20-40 and 40-60 cm) for two farmland types (paddy field and upland field) in three regions influenced by collapsing gully erosion. The three regions are described as follows: strongly influenced region (SIR), weakly influenced region (WIR) and non-influenced region (NIR). The results show that collapsing gully erosion significantly increased the soil gravel and sand content in paddy and upland fields, especially the surface soil in the SIR and WIR. In the 0-20 cm layer of the paddy field, the highest gravel content (250.94 g kg-1) was in the SIR and the lowest (78.67 g kg-1) was in the NIR, but in the upland filed, the surface soil (0-20 cm) of the SIR and the 40-60 cm soil layer for the NIR had the highest (177.13 g kg-1) and the lowest (59.96 g kg-1) values of gravel content, respectively. The distribution of gravel and sand decreased with depth in the three influenced regions, but silt and clay showed the inverse change. In the paddy field, the average of sand content decreased from 58.6 (in the SIR) to 49.0% (in the NIR), but the silt content was in a reverse order, increasing from 27.9 to 36.9%, and the average of the clay content of three regions showed no significant variation (P〈0.05). But in the upland filed, the sand, silt and clay fluctuated in the NIR and the WIR. Soils in the paddy and upland field were highly acidic (pH〈5.2) in the SIR and WIR; moreover lower nutrient contents (soil organic matter (SOM), total N and available N, P, K) existed in the SIR. In the 0-20 cm soil layer of the paddy field, compared with the NIR and the WIR, collapsing gully erosion caused a very sharp decrease in the SOM and total N of the SIR (5.23 and 0.56 g kg-1, respectively). But in the surface soil (0-20 cm) of the upland field, the highest SOM, total N, available N, available P and available K occurred in the NIR, and the lowest ones were in the SIR. Compared with the NIR, the cation exchange capacity (CEC) in the SIR and WIR was found to be relatively lower. These results suggest that collapsing gully erosion seriously affect the soil physical and chemical properties of farmland, lead to coarse particles accumulation in the field and decrease pH and nutrient levels.

文摘Increased food demand from the rapidly growing human population has caused intensive land transition from desert to farmland in arid regions of northwest China. In this developing ecosystem, the optimized fertilization strategies are becoming an urgent need for sustainable crop productivity, efficient resources use, together with the delivery of ecosystems services including soil carbon(C) and nitrogen(N) accumulation. Through a 7-year field experiment with 9 fertilization treatments in a newly cultivated farmland, we tested whether different fertilizations had significant influences on soil C and N accumulation in this developing ecosystem, and also investigated possible mechanisms for this influence. The results showed that applying organic manure in cultivated farmland significantly increased the soil C and N accumulation rates; this influence was greater when it was combined with chemical fertilizer, accumulating 2.01 t C and 0.11 t N ha^(–1) yr^(–1) in the most successful fertilization treatment. These high rates of C and N accumulation were found associated with increased input of C and N, although the relationship between the N accumulation rate and N input was not significant. The improved soil physical properties was observed under only organic manure and integrated fertilization treatments, and the significant relationship between soil C or N and soil physical properties were also found in this study. The results suggest that in newly cultivated farmland, long term organic manure and integrated fertilization can yield significant benefits for soil C and N accumulation, and deliver additional influence on physical properties.
文摘The red thread of the AI-IP-EI Trilogy fate of this study, may have the appearance of a pot-pourri of intellectual and intelligence natures, as a matter of fact that it emanates from the genesis and practical synergism of the trilogy components. Concretely: The paper goes from: AI (Artificial Intelligence)—to the related IP (Intellectual Property) domain—to the relevance of EI (Emotional Intelligence);thus, forming the new AI-IP-EI Trilogy and its attributes and specific impacts to the new innovation process, and business model dimensions. These impacts are outlined and illustrated in part in essays of specific sections and all along. Several concrete study cases are used in the various dedicated sections;such as cases respective to the inventor status, and the EI factor, to the sport education innovative dimension, as well as to biases as inevitably promoting and revealing, to drastically enlarge open innovation supported by constructivism and creations of musical group as a model of open reflexive education. Overall resulting adapted business models appear to have a massive potential, and a multidimensional reach with a necessary attention to the IP policy on going definition. The durable green dimension is exemplified as well. The Ethics-plus, “@LEAST<span style="font-family:Verdana, Helvetica, Arial;white-space:normal;background-color:#FFFFFF;">?</span>”, said corpus is proposed. Could a human centric, AI-adapted-IP policy, internationally embraced, take part to some level of arbitrage, normative and enduring reliability in the field of interest? This seems to be “en route”. Shall the EI (Emotional Intelligence) factor be supervised? Likely so. Is traditional open innovation renewed to a more comprehensive, more inclusive dimension reminding best business practice and now “beyond”? Definitely, and will remain an opportunity, all along the 4IR quantum game changer to come. Neither seeking an in-depth expert analysis, nor a grand public over-simplified bavardage, of the trilogy, AI-IP-EI, four authors here propose an illustrated view of scientific, educational, visionary, demonstrative value to the subject matter. They are aged about 30-40-50-60, being IP & Innovation strategist, future IP lawyer, children-teacher and professional academy sport coach, illustrator and bio-advanced materials engineering “Fellow Scientist”. With experience of large and smaller organizations, being involved innovators, inventors and private artists as well, they are sharing their “non-jargonized down-to-earth”, forward looking views through a structured analysis of the trilogy using realistic examples and data from rather diverse specialized independent sources, biotechnology, nanomaterials, sport… New invention and inventorship is been “reconceptualized” at least from an “insighter or insider” viewpoint, and sport team approach more broadly revisited from its academy level to its commercial asset impact, via educational virtues and values. Music group constructivism enters the scene as well with its exemplary reflexivity and alterity valued for open innovation. Science is the prime lead. “Emotional intelligence, EI, is still an emerging area within AI” and beyond? A new open innovation scheme is taking place. This prompted our intention to further contribute to this matter. Is EI, the tree gently challenging the wind? Generated by AI and IP streams and scientific applications therewith? Naturally. Conclusions are encouraging the follow-up of promising orientations underlined by the AI-IP-EI Trilogy, favoring human centric feature adoptions.
文摘From the author, there are not less than a dozen of rather significant recent publications in scientific editions anticipating some aspects of importance to innovation such as “bigger data”, AI, IP, and frontier technology with a central massive contribution in 2020 on AI, IP, and EI. Nonetheless, the IP associated with AI remains still barely covered in scientific publications. Especially patent discussion tends to be rather a legal matter. Another trilogy, 2013, “Business Strategy-IP Strategy-R&D Strategy: An All-in-One Business Model” proposed by the author, marked the advent, and customized implementation of a new strategy level. After the two trilogies’ volumes, the AI-IP “accessibility” chapter was a logical step brought to the attention of a larger public by the author. The time now to bring to light another chapter, namely the IP eligibility of AI innovation steps in ad hoc inventions. The main objectives of this short, principally illustrated communication, are to: 1) Revise the best mode requirement status, i.e. the best way to enable the reproducibility of claimed matter, reviewing its need for improvement when AI is involved. And proposing a unique sequence of evolution inspired by IP’s current and evolving practices. 2) Give a new dimension to visual aids to help the Best Mode description, demystify AI complexity, and underline frontier traits that may hinder a confident adoption or well-argued rejection. 3) Further illustrations take into account the fact that IoT, AI, and 3D can be simpler than perceived. 4) Finally ATA©, Adjacent Technology Analysis, is timely refreshed in a unique challenging, indeed tumultuous, environment. 5) Bias, such as semantic ones is consistently monitored. 6) Overall leaving space for innovative pleasurable interpretation. The emphasis is on educational, illustrative and demonstrative value.
