An Empirical Study on the Differences between Overt Translation and Covert Translation in Legal

Currently,it is key to convey precise meanings to readers for translators.Observing expressing habits between different languages is the precondition to make target texts more readable.It is crucial to ensure the exactness and seriousness of legal texts,but it does not mean that translators have to take machined way to leave out and even give up transmitting in-deep cultural implications for the intention of achieving the all-inclusive integrity of target content.It is a correct choice for translators to take overt translation and covert translation in line with traits of source language and target language and differences between civil law system and common law system.The intention of the article is to make an empirical study between overt translation and covert translation.

On educational system of legal translation course in colleges of China

With the broadening of economic and commercial communication between China and the outside world, the market of legal and contract document translation job is blooming harshly in both China and abroad. Accompanying this tendency, the professionalizing forensic development of translation is booming up as well. The request for higher education institutions to establish the education system of forensic translation is shining in human＇s eyes, and the cultivating system for the future, the world and profession is highly regarded. So comprehensive profession-cultivating, socialization and economy-serving should be the direction of the education of foreign languages department, related foreign forensic document translation and professional direction of public foreign language teaching as well are the aims of this reform of education. So the aim of this new education system should be the establishing the system of professional translation, forensic translation, cross-subject education and the cultivation of multi-professionals.

Strategies of English Legal Translation

In recent years,China is deepening reform and opening up to the outside world especially after China's successful accession to the WTO.Sino-foreign communication in the field of law is on the rise day by day along with the rapid development of globalization.As can be seen from the previous legal translation studies both in the western world and in China,scholars or researchers have made much effort to conduct studies of legal translation.In this thesis,the basic features of Strategies in legal translation are introduced with some examples in the legal translation practices.And it is explained how to produce a successful legal translation.

Legal English Vocabulary and Its Translation

There are differences between legal English and general English.Legal English relates to the legal profession.Law needs to maintain the impression of seriousness,standardization,accuracy and objectiveness,and as a result,legal English also has these characteristics.Compared to general everyday English,the application of legal English vocabulary requires consideration of these characteristics.In the translation of legal content,attention is also needed to be paid to the characteristics of forensic linguistics.Standardized legal terms are used in the translation of legal regulations and other content to keep the characteristics of faithfulness,accuracy,smoothness and consistency.In this paper,legal English vocabulary is discussed based on its characteristics,as well as the method of translation of legal content.For practical translation of legal English,translation methods include literal translation,free translation and addition and omission.These methods are briefly discussed in this paper.

A Study of the Translation of English Legal Vocabulary under the Guidance of the Skopos Theory

With the rapid development of society,most of countries around the world are all attaching importance to the construction of the rule of law.Many countries are drawing lessons from each others’excellent legal achievements.Legal translation is an important branch of translation field and is playing an increasingly essential part in legal changes.With the deepening of China’s rule of law,China’s construction of legal system has stepped into a new phase.A large number of excellent Chinese legal documents are being translated into English,and many laws of Britain and America also have been translated into Chinese.The globalization of law has been an irreversible tendency.With the vigorous development of legal translation,how to correctly translate foreign legal achievements into Chinese has become a very arduous task for translators.The research field of legal translation includes the study of vocabulary,discourse,sentence and so on.The quality of translation of English legal vocabulary is key to deciding the quality of the whole translation of the legal text.Guided by the Skopos theory,which is a well-known theory put forward by German School of translation,the author makes a preliminary study on the translation of English legal vocabulary.By using and analyzing example sentences,the author makes summary about five characteristics of English legal vocabulary:common English vocabulary expressing legal meanings,use of ancient English vocabulary,parallel use of synonyms,use of modal verbs,use of professional terms and legal jargon.On the premise of conforming to the Skopos theory,four strategies of translating English legal vocabulary are summarized by the author according to these characteristics of English legal vocabulary,which are respectively fuzzy processing of English legal vocabulary,giving play to translators’subjectivity,possessing consciousness of legal texts,correct use of domestication and foreignization.The author stresses the important role of translators’subjectivity in the translation of English legal vocabulary,the correct use of domestication and foreignization and lastly links characteristics of English legal vocabulary,the Skopos theory and strategies of translation of English legal vocabulary effectively.The study has the certain innovation and reference significance in improving the quality of legal translation.

Cross-Language Information Extraction and Auto Evaluation for OOV Term Translations

OOV term translation plays an important role in natural language processing. Although many researchers in the past have endeavored to solve the OOV term translation problems, but none existing methods offer definition or context information of OOV terms. Furthermore, non-existing methods focus on cross-language definition retrieval for OOV terms. Never the less, it has always been so difficult to evaluate the correctness of an OOV term translation without domain specific knowledge and correct references. Our English definition ranking method differentiate the types of OOV terms, and applies different methods for translation extraction. Our English definition ranking method also extracts multilingual context information and monolingual definitions of OOV terms. In addition, we propose a novel cross-language definition retrieval system for OOV terms. Never the less, we propose an auto re-evaluation method to evaluate the correctness of OOV translations and definitions. Our methods achieve high performances against existing methods.

A perspective from Kenneth＇s works： On musical term translation

This paper mainly discusses some translation issues on musical works and terms of musical documents. Musical term translation is established by usage, musical researchers and those who understand music have no problems of understanding the musical terms and musical instruments and names of famous musicians. Foreign scholars obtain the ideas of Chinese culture by means of published writings in the mainland, Taiwan and Hong Kong, and also from the media and the Internet. Since there are cultural differences of mainland, Taiwan and Hong Kong, they may make misunderstanding in their works related to Chinese musicians, historical events and even musical instruments. Accurate back-translation of specific terms from the works written by foreign scholars requires corresponding specific and historical knowledge, consulting dictionaries and skills of using the Internet.

Potential Legal Issues and Care Implications during Care-Prevention Gymnastic Exercises for the Elderly Using Pepper in Long Term Health Care Facilities

In Japan, the shortage of personnel is a problem in long-term care nursing and rehabilitative care prevention. Nevertheless, Japan has taken measures to compensate for these shortages by promoting medical and nursing care activities using robotic technologies, and employing human resources from overseas. The purpose of this study was to determine potential legal issues and subsequent implications for care during prevention gymnastic exercises for the elderly using Pepper in long-term health facilities. The application program of Care-Prevention Gymnastics Exercises for Pepper (Pepper with CPGE) was made by the Xing Company Japan. Currently, care workers become intermediaries for the safe use of Pepper with CPGE. However, it was realized that some legal issues may arise if Pepper with CPGE alone will carry out these preventive care programs for the elderly without the presence of care workers as intermediaries. In this situation, using Pepper with CPGE alone to conduct care prevention gymnastics will require safety measures to prevent these possible practice issues and anticipate implications for care. In this regard, determining detailed target levels of rehabilitation exercise demands and environmental setting safety become essential factors. The use of humanoid robots in healthcare is expected to influence more practice protocols in contemporary and futurist rehabilitative human care. The identification of possible safety issues in performance and environmental situations, and implications for care are critical to ensure safe and valuable rehabilitative health care practices for the elderly population.

On Legal English Translation from the Perspective of Legal Linguistics

With the deepening trend of globalization and the development of economy and society, the demand for international exchange talents is increasing. Especially with the increasing number of transnational corporations, almost every company should have professional legal translation employees to guarantee their legitimacy of transnational trade and effectively prevent the infringement of related rights and interests. Therefore, to improve the quality in transnational translation business and optimize legal English translation skills from the perspective of legal language can not only offer a reference for the industry, but also provide evidence for the problems arising from the actual legal translation process. Based on the perspective of legal linguistics, this paper tries to puts forward appropriate legal English translation measures mainly by analyzing the skills of legal English translation, with a view to providing some references for relevant scholars.

A Corpus-based Study of the Chinese Translation for the Conditional Clause Pattems in Intemational Legal Instruments

The Chinese translation for international legal instruments is an indispensable part in national political and economic fields. Apart from legal terminology, the syntactical features of international legal instruments also deserve study. They are easy to be seen in the use of some typical sentence patterns, such as long and complex sentence structures, passive voice and provisos or conditional clauses. Based on the parallel English-Chinese international conventions, this paper mainly evaluates the current Chinese translation and summarizes the use frequency and translation strategies for the conditional clause patterns. From the perspective of memetics, sentence patterns can be units of imitation, and the summary of and comments on them and their Chinese translation will promote the transmission across culture and help a legal translator improve his/her expertise, which will eventually be good for successful cooperation in international business.

An Empirical Study of Legal English Translation Teaching Through Wechat-based Mobile Learning Platform

This paper illustrates the functions of smartphone-based teaching using the theory of constructivism,and puts forward anew learning strategy to replace traditional cram-teaching methods.We examines the new paradigm in the formation of translationcompetence within the legal discourse.It aims to promote the autonomous learning,monitor the students’participation,facilitatestudents’communication and provide well-structured materials to transform traditional classroom learning into mobile phonelearning,to maximize students’initiative and enthusiasm,as well as help students engage in,interpret,and negotiate the complexi-ties that surround them.The findings of this study have been summarized into a few generalizations for possible directions for trans-lation research and they provide a better understanding of Chinese students’translation competence within a legal English contextand contribute to the translation skill development.Series on existing research on translation competence development in classroomteaching contexts for empirical guidance,as an essential component of ESP curriculum based on authentic data and analyzedthrough online framework specifically designed for legal discourse.

A Study of Legal Translation from the Perspective of Frame Semantics

Due to the special features of legal English, its translation is different from the translation of others. In fact, legal translation can be deemed as a double operation between legal transfer and language transfer. Thus, many factors need to be taken into consideration in legal translation. Frame semantics is just the perspective of translation which provides a new angle to the legal translation. This paper proposes three strategies for legal translation based on frame semantics. The three strategies are frame correspondence, frame selection and frame transfer.

THE FEATURE AND CONDITION OF THE TRANSLATION OF CHINESE LEGAL DOCUMENTS

Accuracy and preciseness are the main features of legal documents, whose usage of words, structural syntax and textual style are directly demanded. When translating legal documents, we should be familiar with, firstly the feature of literary style of it, and secondly, the two big difficulties that are between the aspects of language and profession. Through the techniques of the translation of legal documents, translating legal documents has principles to follow even though it involves many questions.This thesis consists of three parts; the first part introduces the features of the translation of Chinese legal documents. It mainly contains the features of Chinese legal documents, common principles of the translation of legal documents, and the techniques of the translation of legal documents. This part fully presents the features of the translation of Chinese legal documents and the importance and difficulty of them. The second part introduces the analysis of the present situation of legal translation. It mainly contains the theories about translation and practice operations. This part concludes the achievements of recent 10 years by searching for the bibliographies. The third part comes up with the existing problems and several methods of solving them by analyzing the present situation of the translation of legal documents.

An Analysis about the Influence of Culture Transfer on Legal Translation from the Perspective of Intercultural Communication

With the increasingly rapid social development,collusion and integration of different culture around the world,legal translation also becomes an exceedingly important tool in exchanges of laws.Legal translation,in essence,is a non-negligible aspect of intercultural communication,because legal translation is not only a transfer process from one language to another language,but also a study process of various legal cultures.In traditional researches about legal translation,most scholars only have a preference to pay more attention to the faithfulness and exactness of target language,but ignore the significance of cultural elements that are key limitations to the readiness of legal translation.Researchers can take advantage of culture transfer,which is a strategy to avoid misunderstandings in process of legal translation for the intention of improving the quality of legal texts.In this paper,legal translation refers to translation between English legal texts and Chinese legal texts.

Towards a Research Paradigm for Diachronic Analyses of Term Travels:A New Perspective of Term Translation Studies

Research on term travels transcends the scope of the single discipline of historical semantics,and should be included in the transdisciplinary area of discourse studies,as such travels are discursive events in history that have both a linguistic and a social aspect.In other words,the travel of terms across cultures should be treated as discourses in history,and the three-fold nature of the concept of“discourse”sheds light upon the building of a model for diachronic analyses of such processes,which helps discourse analysts sharing the same goal work together to draw more scholarly attention to academic issues at the crossroads of history,language,and society.

Legal English Translation from the Perspective of Skopostheorie

As any other legal language does,legal English features a wealth of complex legal concepts as well as plenty of highly and unique professional terms and complicated syntax.Proper translation of legal English texts into legal Chinese ones will throw a great social and economic impact on the society.Accordingly "accuracy" has always been regarded as the primary principle of legal English translation.However,as legal English falls within the ambit common law system and legal Chinese within the civil law system,to obtain real accuracy or even the effect of "equivalence" still remains an ideal pursuit of legal English translation standard.Having probed into Skopostheorie,which "boasts itself of one of the deconstructive translation studies"〔1〕 and focuses on the target-text's function and practicability,the author of this article finds that as to legal English translation skopos theory,in terms of text typology,offers a reasonable elucidation for a couple of translation strategies adopted in the target text.

A Prototype Approach to the Chinese-English Focal Color Term Translation
