The participation of women in legislation is an important aspect and means of safeguarding women’s rights.Feminist theory,based on criticism of both the“citizenship identity theory as rights”and the“citizenship id...The participation of women in legislation is an important aspect and means of safeguarding women’s rights.Feminist theory,based on criticism of both the“citizenship identity theory as rights”and the“citizenship identity theory as responsibilities,”proposes the“citizenship identity theory as subjectivity.”Observing the current practice of women’s participation in legislation in China,two institutional safeguard principles can be summarized:the“minimum proportion”and the“influence evaluation.”However,each of these principles has its inherent limitations.Therefore,it is necessary to supplement them with the principle of“subjective participation”in a reflective manner.This principle requires women to participate substantively in the legislative process as subjects,express women’s needs and demands,input women’s perspectives and experiences,and reconstruct the distribution of rights and responsibilities in the existing legislation.The three principles complement each other and work together to comprehensively constitute the institutional structure of women’s participation in legislation,thereby promoting the reproduction of corresponding action structures.展开更多

This paper examines the primary institutions that are involved in promoting renewable policies in China, the structure of the policies that currently are being drafted, and the status of the complementary, national-level renewable energy law being drafted to provide a legal basis for ongoing local and national-level policies. Oriented by the idea to formulate China's space law as soon as possible, it is necessary to solve five key issues. In the national policy, it is needful not only to implement China's space policy and promote the development of the space industry in depth, but also to advance the deep integration of military and civil application in space field. In terms of legal orientation, three features should be reflected upon, including the functional integration of public and private laws, the balance of regulation by substantive and procedural laws, and the effective coordination of domestic and international laws. The system of people’s congresses realizes the broad participation of the people in national and local legislation through various channels. It fully reflects the fundamental interests and common will of the great majority of the people. The democratic and professional combination of subjects for legislation with Chinese characteristics has, to a great extent, solved the contradictions and difficulties encountered in the legislation of countries with the representative system. The system of multi-party cooperation and political consultation under the CpC’s leadership realizes the promotion of democracy, the drawing on collective wisdom, the unifying of people’s thinking, and the building of consensus among the CpC, the democratic parties, and the general public in the process of legislation. Legislative planning is not only a result of scientific decision-making, but also one of the best democratic decision-making mechanisms proved by legislative practices. The openness, negotiation, and technical nature of legislative procedures in China are conducive to the realization of democratic management. China has established a relatively scientific, complete, and systematic constitutional filing and review system, which is also an embodiment of democratic supervision. In future legislation, China should continue to transform the values and concepts of democracy and human rights into more scientific and effective institutional arrangements and concrete and realistic democratic practices under the leadership of the CpC.展开更多

Objective This study assesses the impact of smoke-free legislation on the incidence rate for acute myocardial infarction(AMI)and stroke in Shenzhen.Methods Data on ischemic(n=72,945)and hemorrhagic(n=18,659)stroke and...Objective This study assesses the impact of smoke-free legislation on the incidence rate for acute myocardial infarction(AMI)and stroke in Shenzhen.Methods Data on ischemic(n=72,945)and hemorrhagic(n=18,659)stroke and AMI(n=17,431)incidence covering about 12 million people in Shenzhen from 2012 to 2016 were used.Immediate and gradual changes in incidence rates were analyzed using segmented Poisson regression.Results Following the smoke-free legislation,a 9%(95%CI:3%-15%)immediate reduction was observed in AMI incidence,especially in men(8%,95%CI:1%-14%)and in those aged 65 years and older(17%,95%CI:9%-25%).The gradual annual benefits were observed only in hemorrhagic and ischemic stroke incidence,with a 7%(95%CI:2%-11%)and 6%(95%CI:4%-8%)decrease per year,respectively.This health effect extended gradually to the 50-64 age group.In addition,neither the immediate nor gradual decrease in stroke and AMI incidence rates did not show statistical significance among the 35-49 age group(P>0.05).Conclusion Smoke-free legislation was enforced well in Shenzhen,which would generate good experiences for other cities to enact and enforce smoke-free laws.This study also provided more evidence of the health benefits of smoke-free laws on stroke and AMI.展开更多

This study examines the spatio-temporal characteristics of heavy precipitation forecasts in eastern China from the European Centre for Medium-Range Weather Forecasts(ECMWF) using the time-domain version of the Method ...This study examines the spatio-temporal characteristics of heavy precipitation forecasts in eastern China from the European Centre for Medium-Range Weather Forecasts(ECMWF) using the time-domain version of the Method for Object-based Diagnostic Evaluation(MODE-TD). A total of 23 heavy rainfall cases occurring between 2018 and 2021 are selected for analysis. Using Typhoon “Rumbia” as a case study, the paper illustrates how the MODE-TD method assesses the overall simulation capability of models for the life history of precipitation systems. The results of multiple tests with different parameter configurations reveal that the model underestimates the number of objects’ forecasted precipitation tracks, particularly at smaller radii. Additionally, the analysis based on centroid offset and area ratio tests for different classified precipitation objects indicates that the model performs better in predicting large-area, fast-moving, and longlifespan precipitation objects. Conversely, it tends to have less accurate predictions for small-area, slow-moving, and shortlifespan precipitation objects. In terms of temporal characteristics, the model overestimates the forecasted movement speed for precipitation objects with small-area, slow movement, or both long and short lifespans while underestimating it for precipitation with fast movement. In terms of temporal characteristics, the model tends to overestimate the forecasted movement speed for precipitation objects with small-area, slow movement, or both long and short lifespans while underestimating it for precipitation with fast movement. Overall, the model provides more accurate predictions for the duration and dissipation of precipitation objects with large-area or long-lifespan(such as typhoon precipitation) while having large prediction errors for precipitation objects with small-area or short-lifespan. Furthermore, the model’s simulation results regarding the generation of precipitation objects show that it performs relatively well in simulating the generation of large-area and fast-moving precipitation objects. However, there are significant differences in the forecasted generation of small-area and slow-moving precipitation objects after 9 hours.展开更多
Over the past few decades,the Internet has rapidly diffused across China.The spread of the Internet has had a profound economic and social impact on Chinese rural areas.Existing research shows that Internet access sig...Over the past few decades,the Internet has rapidly diffused across China.The spread of the Internet has had a profound economic and social impact on Chinese rural areas.Existing research shows that Internet access significantly impacts agricultural production and improves smallholder farmers’income.Beyond these,the Internet can affect other dimensions of social welfare.However,research about the impact of Internet access on dietary quality in rural China remains scarce.This study utilizes multi-period panel data from Fixed Observation Point in rural China from 2009 to 2015 to estimate the impact of Internet access on dietary quality and food consumption of rural households and conducts a causal analysis.Regression models with time and household fixed effects allow robust estimation while reducing potential issues of unobserved heterogeneity.The estimates show that Internet access has significantly increased rural household dietary quality(measured by the Chinese Diet Balance Index).Further research finds that Internet access has increased the consumption of animal products,such as aquatic and dairy products.We also examine the underlying mechanisms.Internet access improves dietary quality and food consumption mainly through increasing household income and food expenditure.These results encourage the promotion of Internet access as a valuable tool for nutritional improvements,especially in rural areas.展开更多

Heavy precipitation and extreme drought have caused severe economic losses over South China and Indochina(INCSC)in recent decades.Given the areas with large gross domestic product(GDP)in the INCSC region are distribut...Heavy precipitation and extreme drought have caused severe economic losses over South China and Indochina(INCSC)in recent decades.Given the areas with large gross domestic product(GDP)in the INCSC region are distributed along the coastline and greatly affected by global warming,understanding the possible economic impacts induced by future changes in the maximum consecutive 5-day precipitation(RX5day)and the maximum consecutive dry days(CDD)is critical for adaptation planning in this region.Based on the latest data released by phase 6 of the Coupled Model Intercomparison Project(CMIP6),future projections of precipitation extremes with bias correction and their impacts on GDP over the INCSC region under the fossil-fueled development Shared Socioeconomic Pathway(SSP5-8.5)are investigated.Results indicate that RX5day will intensify robustly throughout the INCSC region,while CDD will lengthen in most regions under global warming.The changes in climate consistently dominate the effect on GDP over the INCSC region,rather than the change of GDP.If only considering the effect of climate change on GDP,the changes in precipitation extremes bring a larger impact on the economy in the future to the provinces of Hunan,Jiangxi,Fujian,Guangdong,and Hainan in South China,as well as the Malay Peninsula and southern Cambodia in Indochina.Thus,timely regional adaptation strategies are urgent for these regions.Moreover,from the sub-regional average viewpoint,over two thirds of CMIP6 models agree that maintaining a lower global warming level will reduce the economic impacts from heavy precipitation over the INCSC region.展开更多

文摘The legislation of China provides a glimpse of the active development of the whole-process people’s democracy in the country. The system of people’s congresses realizes the broad participation of the people in national and local legislation through various channels. It fully reflects the fundamental interests and common will of the great majority of the people. The democratic and professional combination of subjects for legislation with Chinese characteristics has, to a great extent, solved the contradictions and difficulties encountered in the legislation of countries with the representative system. The system of multi-party cooperation and political consultation under the CpC’s leadership realizes the promotion of democracy, the drawing on collective wisdom, the unifying of people’s thinking, and the building of consensus among the CpC, the democratic parties, and the general public in the process of legislation. Legislative planning is not only a result of scientific decision-making, but also one of the best democratic decision-making mechanisms proved by legislative practices. The openness, negotiation, and technical nature of legislative procedures in China are conducive to the realization of democratic management. China has established a relatively scientific, complete, and systematic constitutional filing and review system, which is also an embodiment of democratic supervision. In future legislation, China should continue to transform the values and concepts of democracy and human rights into more scientific and effective institutional arrangements and concrete and realistic democratic practices under the leadership of the CpC.
文摘The Law on the Protection of Women’s Rights and interests has been amended twice since it was promulgated 1992,and it has formed a relatively complete legislation system together with relevant laws and regulations,accumulating experience of judicial application in practice.In the current proposed amendment of the Law on the Protection of Women’s Rights and interests,the main issues that should be considered are:First,the legislative purpose of this law should be reviewed to clarify the three legislative positions of the Law on Women’s Rights and interests,in terms of protection,practice and foundation.Second,it is necessary to grasp whether the text content is appropriate and rectify any defects in the existing text.Third,it should explore how to reform and implement specific systems from the micro perspective to improve the specific systems of women’s personal,property,and social rights and interests.Fourth,it should strengthen the systematic interaction with other norms at different levels and implement the principle of gender equality stipulated in the Constitution of the People’s Republic of China.Fifth,attention should be paid to the necessity of invoking the Law in judicial practice,the possibility of operation and the effectiveness of enforcement.The proposed amendment of the Law on the Protection of Women’s Rights and interests should also sum up the experience of local legislation and judicial decisions and improve the quality of judicial application of the law so that is truly responds to the practical needs and challenges of the protection of women’s rights and interests and the implementation of gender equality in the new era.
文摘Biodiversity conservation depends on a sound legislation in both international and national levels.China has promulgated a series of laws and regulations concerning biodiversity conservation,especially for protection of wild animals and other natural resources.As the enforcement of the statutes,a great progress for in-situ and ex-situ biodiversity conservation has been achieved.But some gaps for the legislation are still existed.Based on the present status of conservation legislation in China and in accordance with the Convention on Biological Diversity,an attention for the legislation should be paid to conservation of genetic resources,wild plant species and various natural ecosystems.

文摘Objective This study assesses the impact of smoke-free legislation on the incidence rate for acute myocardial infarction(AMI)and stroke in Shenzhen.Methods Data on ischemic(n=72,945)and hemorrhagic(n=18,659)stroke and AMI(n=17,431)incidence covering about 12 million people in Shenzhen from 2012 to 2016 were used.Immediate and gradual changes in incidence rates were analyzed using segmented Poisson regression.Results Following the smoke-free legislation,a 9%(95%CI:3%-15%)immediate reduction was observed in AMI incidence,especially in men(8%,95%CI:1%-14%)and in those aged 65 years and older(17%,95%CI:9%-25%).The gradual annual benefits were observed only in hemorrhagic and ischemic stroke incidence,with a 7%(95%CI:2%-11%)and 6%(95%CI:4%-8%)decrease per year,respectively.This health effect extended gradually to the 50-64 age group.In addition,neither the immediate nor gradual decrease in stroke and AMI incidence rates did not show statistical significance among the 35-49 age group(P>0.05).Conclusion Smoke-free legislation was enforced well in Shenzhen,which would generate good experiences for other cities to enact and enforce smoke-free laws.This study also provided more evidence of the health benefits of smoke-free laws on stroke and AMI.
文摘This paper introduces agricultural catastrophe and its characteristics,and conducts comparative analysis on existing mechanism of spreading agricultural catastrophe risk,indicating that the mechanism of administrative remedy has the greatest efficiency and highest cost;the mechanism of social assistance has the lowest cost,but its efficiency is lowest and there are unstable factors;market mechanism,namely the insurance of agricultural catastrophe,is the rational choice of agricultural department in mechanism of risk spreading.This paper analyzes the status quo of China's insurance of agricultural catastrophe,indicating that the main body of management in China's insurance of agricultural catastrophe is missing.In addition,the market demand is critically scanty,and insurance of agricultural catastrophe lacks external development environment.The gap of China's insurance law of agricultural catastrophe has become the greatest obstacle to the development of insurance of agricultural catastrophe.From legislative purpose,basic principle,nature,main body of legal relations,management range,policy support,supervision and management and so on,the legislation conception of China's insurance of agricultural catastrophe is put forward.

文摘China's poor energy development and in-situ conversion legislation, environment laws and energy laws lead to a severe environmental issue in energy source. This paper uses comparison and logical methods to discuss Chapter 4 of Energy Law (Draft for Soliciting Opinions). Energy development is taken as a separate chapter; in-situ energy conversion is added to energy processing and conversion, common features are summarized to form general provisions and other provisions. According to respective characteristics of system for total amount control of energy development, performance guarantee system, environmental trust fund system, energy retaining system and environmental lien system, incorporate them into energy development, in-situ energy conversion and energy processing and conversion, in the hope of solving China's shortage of supply for environmental protection laws on energy development and in-situ conversion, responding to times of environmental protection, and optimizing China's Energy Law.

文摘This study examines the spatio-temporal characteristics of heavy precipitation forecasts in eastern China from the European Centre for Medium-Range Weather Forecasts(ECMWF) using the time-domain version of the Method for Object-based Diagnostic Evaluation(MODE-TD). A total of 23 heavy rainfall cases occurring between 2018 and 2021 are selected for analysis. Using Typhoon “Rumbia” as a case study, the paper illustrates how the MODE-TD method assesses the overall simulation capability of models for the life history of precipitation systems. The results of multiple tests with different parameter configurations reveal that the model underestimates the number of objects’ forecasted precipitation tracks, particularly at smaller radii. Additionally, the analysis based on centroid offset and area ratio tests for different classified precipitation objects indicates that the model performs better in predicting large-area, fast-moving, and longlifespan precipitation objects. Conversely, it tends to have less accurate predictions for small-area, slow-moving, and shortlifespan precipitation objects. In terms of temporal characteristics, the model overestimates the forecasted movement speed for precipitation objects with small-area, slow movement, or both long and short lifespans while underestimating it for precipitation with fast movement. Overall, the model provides more accurate predictions for the duration and dissipation of precipitation objects with large-area or long-lifespan(such as typhoon precipitation) while having large prediction errors for precipitation objects with small-area or short-lifespan. Furthermore, the model’s simulation results regarding the generation of precipitation objects show that it performs relatively well in simulating the generation of large-area and fast-moving precipitation objects. However, there are significant differences in the forecasted generation of small-area and slow-moving precipitation objects after 9 hours.

文摘Over the past few decades,the Internet has rapidly diffused across China.The spread of the Internet has had a profound economic and social impact on Chinese rural areas.Existing research shows that Internet access significantly impacts agricultural production and improves smallholder farmers’income.Beyond these,the Internet can affect other dimensions of social welfare.However,research about the impact of Internet access on dietary quality in rural China remains scarce.This study utilizes multi-period panel data from Fixed Observation Point in rural China from 2009 to 2015 to estimate the impact of Internet access on dietary quality and food consumption of rural households and conducts a causal analysis.Regression models with time and household fixed effects allow robust estimation while reducing potential issues of unobserved heterogeneity.The estimates show that Internet access has significantly increased rural household dietary quality(measured by the Chinese Diet Balance Index).Further research finds that Internet access has increased the consumption of animal products,such as aquatic and dairy products.We also examine the underlying mechanisms.Internet access improves dietary quality and food consumption mainly through increasing household income and food expenditure.These results encourage the promotion of Internet access as a valuable tool for nutritional improvements,especially in rural areas.
文摘Boehmeria nivea var.strigosa Zeng Y.Wu&Y.Zhao,a new variety of B.nivea(Urticaceae)from Southwest China,is here described based on evidence from morphology and molecular phylogeny.This new variety is mainly characterized by its green abaxial leaf blade,partly connate stipules,and densely patent strigose hairs on stems and potioles.The phylogenetic analysis based on rbc L,nrDNA and rbc L+nrDNA datasets,revealed that all individuals of B.nivea var.strigosa formed a monophyletic group.The conservation status of B.nivea var.strigosa is assessed as“Near Threatened”(NT)according to IUCN evaluation criteria.The discovery of this new variety is not only crucial for the taxonomy of ramie,but also provides reference for the exploration and utilization of ramie.
文摘Heavy precipitation and extreme drought have caused severe economic losses over South China and Indochina(INCSC)in recent decades.Given the areas with large gross domestic product(GDP)in the INCSC region are distributed along the coastline and greatly affected by global warming,understanding the possible economic impacts induced by future changes in the maximum consecutive 5-day precipitation(RX5day)and the maximum consecutive dry days(CDD)is critical for adaptation planning in this region.Based on the latest data released by phase 6 of the Coupled Model Intercomparison Project(CMIP6),future projections of precipitation extremes with bias correction and their impacts on GDP over the INCSC region under the fossil-fueled development Shared Socioeconomic Pathway(SSP5-8.5)are investigated.Results indicate that RX5day will intensify robustly throughout the INCSC region,while CDD will lengthen in most regions under global warming.The changes in climate consistently dominate the effect on GDP over the INCSC region,rather than the change of GDP.If only considering the effect of climate change on GDP,the changes in precipitation extremes bring a larger impact on the economy in the future to the provinces of Hunan,Jiangxi,Fujian,Guangdong,and Hainan in South China,as well as the Malay Peninsula and southern Cambodia in Indochina.Thus,timely regional adaptation strategies are urgent for these regions.Moreover,from the sub-regional average viewpoint,over two thirds of CMIP6 models agree that maintaining a lower global warming level will reduce the economic impacts from heavy precipitation over the INCSC region.
