Stray Soul——A Psychoanalysis of the Reasons of Children's Murder in Lord of the Flies

Lord of the Flies is the first and outstanding novel by William Golding①, the Nobel Prize winner. In this novel, Golding exposes the dark side of human nature. What have left an impressive shocking image in this novel are the three bloody incidents occurring among the originally innocent children. After a brief introduction to Lord of the Flies and comparison and contrast of the three murders, we find that the reasons are not only "the dark side of human nature", but also the death instinct, the instinct of fear and power, which are derived from psychoanalysis. Undeniably, the external factors, such as the social circumstance and natural surroundings are also responsible for the boys' uncontrolled behavior.

Births, economic growth, mortality and murder in a developing country

Background: In 1960, total fertility rate in Jamaica was 5.6 children per woman which declined by 57.5% in 2008. The reduction in fertility is primarily attributable to contraceptive measures;but murder and other selected macroeconomic variables have never been included in the literature. Objectives: This study examines murder, mortality, and selected macroeconomic variables are factors of births, using data for Jamaica from 1989-2009. Methods: The study is a secondary data analysis of statistics on Jamaica from 1989 - 2009 but also includes data on births from 1900s. Find- ings: In the decade of the 1950s, births increased by 79.9% over the decade of 1900s, grew by 22.4% in the 1960s over the previous decade and declined by 17.6% in 2000s compared with the 1990s. Four emerged as statistically significant predictors of lnbirth—inflation, GDP per capita growth, mortality and murder, with an explanatory power of 90.6%—F = 19.291, P s = 0.962), when murder was excluded and replaced by annual exchange rate, the factors influencing lnbirth was exchange rate, inflation, unemployment, GDP per capita growth and mortality—all factors account for 92.2% of the variability in lnbirth—F = 30.572, P < 0.0001. Conclusion: Murder is more that a crime it is a cause of birth decline, suggesting that public health practitioners as well as epidemiologists must take this factor into account as it is a birth determinant.

The Chinese Maze Murders是著名汉学家高罗佩创作的《狄公案》系列小说中的一部中长篇,也是唯一一部作者本人用中文翻译的作品。本文从译者惯习的角度,对比分析高罗佩的自译本与陈来元的译本,挖掘译者翻译行为背后的原因。本文发现,不同的译文之所以在各方面有不同的呈现,与译者的惯习息息相关,而译者惯习的形成又与其社会环境密不可分,因此,从译者惯习的角度分析翻译行为,可以发掘出社会客观因素与译者主观因素对译文的作用。

A Retrospective Analytical Study of Forensic Evidence in Rape and Murder Cases and its Implications on Judicial Outcomes in India

In rape and murder cases,forensic science precisely establishes the link between the accused and either the victim or the crime scene,or both,which aids police investigation and the trial process by providing scientific evidence to corroborate or contradict the accused’s guilt.This study focuses on the importance of forensic evidence in deciding rape cases in India.This study aimed to analyze the correlation between forensic evidence and judicial outcomes in determining the conviction rate.This is a retrospective analytical study of rape and murder cases of the Supreme Court of India(SCI)Judgments from 1992 to 2021 using the library and digital library resources.The data obtained were subjected to Pearson’s correlation test to assess the relationship between forensic evidence and judicial outcomes.The results were considered statistically significant at P<0.05.In 20(5.22%)sensational,heinous rape and murder cases,13(65%)cases had proper handling of the forensic samples,while 7(35%)cases had improper handling of the forensic samples or inconsistent forensic reports were given.Based on the forensic reports and other factors,the SCI affirmed the sentence in 11(55%)cases,commuted imprisonment in 7(35%)cases,and acquitted 2(15%)cases.Further,the statistical analysis shows that forensic evidence and judicial outcomes have a moderately positive correlation with each other(0.2<r<0.5,P<0.05).In rape and murder cases,SCI judgments have a high conviction rate.However,the SCI commuted the sentence based on inconsistent forensic reports and acquitted based on mishandled forensic reports.

宽严相济视角下义愤杀人犯罪的认定标准与量刑规范——以217份刑事判决书为样本

义愤杀人案件因其情与法、人伦孝义与犯罪事实的复杂交织而频频引发社会关注。当前司法实务中对义愤杀人犯罪存在认定标准不一、义愤情节易被忽视、量刑畸轻畸重甚至同案不同判等问题。定罪方面,引起义愤杀人的“不义”行为应严格限定为严重悖德行为,只有“不义”行为的实施对象及与实施对象有特殊关系者才能够被认定为义愤杀人者,为终结长期迫害的“非当场性”杀人行为也可以被认定为义愤杀人。量刑方面,应当将“义愤”动机(原因)作为确定义愤杀人犯罪量刑起点的基本犯罪构成事实,以普通故意杀人罪的量刑规范确定基准刑,并综合案件实际,依据犯罪行为的社会危害程度和犯罪人的人身危险程度,谨慎、严格地把控义愤杀人犯罪中量刑情节的调节幅度。

受虐妇女选择在家暴结束后趁丈夫熟睡或者以下毒的方式将其杀害,这是一种典型的非对峙型受虐妇女反杀行为,入罪结论不符合民众的情感期待,出罪空间有限。其出罪难点是不符合正当防卫“不法侵害正在进行”的时间条件,容易定性为事前防卫;如果通过“受虐妇女综合症”把这种家暴行为视为一种持续侵害行为,容易定性为事后防卫。因此,理解非对峙型受虐妇女反杀案的出罪逻辑,应从紧急避险的“防御性”上做实质判断,受虐妇女为避免遭受家暴,当施暴丈夫对其实施不法侵害难以察觉时,基于生命权冲突的利益衡量,不得已选择反杀行为具有出罪的正当性。

英美法系的挑衅抗辩及其对中国刑法的启示

英美法系适用于谋杀罪指控的挑衅抗辩因其司法实践中展现的性别歧视、对女性特质的忽略及理性自然人标准判定的困难而饱受争议。但从理论根据看,部分宽恕说认为被挑衅者的主观应受谴责性较小,部分正当说认为受挑衅而杀人者的客观错误较小,故挑衅抗辩的存在有一定正当性。本文建议,中国应当借鉴英美法系地区针对挑衅抗辩作出系列改革,将挑衅情节加入法定量刑情节之中,并明文规定挑衅抗辩的适用条件。

精神分裂症193例暴力行为案例分析

本文报道了193例具有暴力行为的精神分裂症病人并对其犯罪性质,手段,规律进行分析。犯罪以凶杀为主要方式。从疾病分型观察以偏执型为多(50.9％),其次为残留型(21.7％)。作案以被害、嫉妒、关系妄想和幻觉的精神症状为主而造成凶杀行为。本文指出为了加强预防和减少病人肇事,维护社会治安,应对各类精神病人积极治疗和管理,实行整个社会来监护。
